<br />to, the California Public Resources Code, relating to solid waste, as amended, supplemented, superseded, and 77
<br />replaced from time to time. 78
<br />“AB 939” means the California Integrated Waste Management Act of 1989 (California Public Resources Code § 79
<br />40000, et seq.), as amended, supplemented, superseded, and replaced from time to time. 80
<br />"AB 1201” means Assembly Bill 1201, approved by the Governor of the State of California on October 5, 2021, which 81
<br />amended Sections 42356, 42356.1, and 42357 of, and amended the heading of Chapter 5.7 (commencing with 82
<br />Section 42355) of Part 3 of Division 30 of, the California Public Resources Code, relating to solid waste, as amended, 83
<br />supplemented, superseded, and replaced from time to time. 84
<br />"AB 1594" means Assembly Bill 1594 approved by the Governor of the State of California on September 28, 2014, 85
<br />which amended Sections 40507 and 41781.3 of the California Public Resources Code, relating to solid waste, as 86
<br />amended, supplemented, superseded, and replaced from time to time. 87
<br />“AB 1669” means Assembly Bill 1669, approved by the Governor of the State of California on September 30, 2016, 88
<br />which amends California Labor Code Sections 1070 through 1076 with respect to the hiring of displaced employees 89
<br />under service contracts for the collection and transportation of solid waste. 90
<br />“AB 1826” means the Organic Waste Recycling Act of 2014 (Chapter 727, Statutes of 2014 modifying Division 30 of 91
<br />the California Public Resources Code), also commonly referred to as "AB 1826," as amended, supplemented, 92
<br />superseded, and replaced from time to time. 93
<br />“AB 2176” means the Large Venue Recycling Act (an act to amend Section 42911 of, and to add Chapter 12.7 94
<br />(commencing with Section 42648) to Part 3 of Division 30 of, the California Public Resources Code, relating to 95
<br />Recycling), also commonly referred to as “AB 2176,” as amended, supplemented, superseded, and replaced from 96
<br />time to time. 97
<br />“Accept” or “Acceptance” (or other variations thereof) means the receipt and acceptance of Delivered Franchised 98
<br />Material by an Approved or Designated Facility that results in a transfer of Ownership of any Franchised Material: i) 99
<br />from the Franchised Collector to Contractor; or, ii) from Contractor to an Approved or Designated Facility. 100
<br />“Actions” means all actions including claims, demands, causes of action, suits, mediation, arbitration, hearings, 101
<br />investigations, inquiries and proceedings, whether legal, judicial, quasi-judicial, governmental or administrative in 102
<br />nature and whether threatened, brought, instituted or settled. 103
<br />“Advanced Clean Fleets Regulation” means 13 CCR Sections 2013, 2013.1, 2013.2, 2013.3, 2013.4, 2014,2014.1, 104
<br />2014.2, 2014.3, 2015, 2015.1, 2015.2, 2015.3, 2015.4, 2015.5, 2015.6, and 2016, as amended, supplemented, 105
<br />superseded, and replaced from time to time. 106
<br />“Affiliate” means any Person, corporation, or other entity directly or indirectly controlling or controlled by another 107
<br />Person, corporation or other entity, or under direct or indirect common management or control with such Person, 108
<br />corporation, or entity. As between any two (2) or more Persons or entities, when ten percent (10%) of one is Owned, 109
<br />managed, or controlled by another, they are hereunder Affiliates of one another. In a joint venture, each party to 110
<br />the joint venture may have his or her own Affiliate. 111
<br />“Agreement” means this Agreement for Materials Transfer Processing, and Diversion Services between the City and 112
<br />Contractor, including all Exhibits, Attachments, and any future amendments hereto. 113
<br />“Alternative Daily Cover (ADC)” means cover material used at a Disposal Site, other than at least six (6) inches of 114
<br />earthen material, placed on the surface of the active face of the refuse fill area at the end of each operating Day to 115
<br />control blowing litter, fires, odor, scavenging, and vectors; or, means materials used as soil amendments for erosion 116
<br />control and landscaping. 117
