Livermore, CA 94551 <br /> <br />Developer shall notify City of any change of address. <br /> <br />Section 5 Labor Code/Prevailing Wages. <br /> <br />To the extent applicable for the Additional Improvements, Developer shall ensure that the contractor <br />performing the work and any subcontractors comply with the requirements of the California Labor <br />Code including but not limited to hours of labor, nondiscrimination, payroll records, apprentices, <br />workers' compensation and prevailing wages. <br /> <br />No less than the general prevailing rate of per diem wages, and not less than the general prevailing rate <br />of per diem wages for holidays and overtime work, for each craft, classification or type of worker shall <br />be paid to all workers, laborers and mechanics employed in the execution of the City-Improvements by <br />the contractor or any subcontractor doing or contracting to do any part of the work. The appropriate <br />determination of the Director of the California Department of Industrial Relations shall be filed with, <br />and available for inspection, at the City offices. The contractor shall post, at each job site, a copy of <br />the prevailing rate of per diem wages. The contractor shall forfeit fifty dollars ($50.00) for each <br />calendar day or portion thereof for each worker paid less than the stipulated prevailing rates. <br /> <br />Section 6 Amendments. <br /> <br />Any amendment or cancellation of this Agreement must be in writing, signed by the appropriate <br />authorities for City and Developer. <br /> <br />Section 7 Applicable Law. <br /> <br />The laws of the State of California shall govern the interpretation and enforcement of this <br />Agreement. Any action to enforce this agreement shall be filed in the Superior Court of the <br />County of Alameda. <br /> <br />Section 8 Counterparts. <br /> <br />This Agreement is executed in three (3) duplicate counterparts, each of which is deemed to be <br />an original. This Agreement constitutes the entire understanding and agreement of the parties. <br />This Agreement integrates all of the terms and conditions and constitutes the entire <br />understanding of the parties with respect to the subject matter. All prior written agreement, <br />understandings, representations, and statements are superseded by this Agreement. <br /> <br />This Cost Reimbursement Agreement is executed the date and year first above written. <br /> <br />SR:05:009 <br />Page 7 of 8 <br /> <br /> <br />
