FISCAL IMPACT

There will be no fiscal impact to the City's submitting a letter to the Supreme Court other than
the time of the City Attorney to draft the letter. The City Attorney will be assisted in this
effort by the arguments that SOS itself makes to the Supreme Court when it files its petition at
the end of December. At the time this staff report is written, that petition has not been
submitted to the Supreme Court.

RECOMMENDATION

Consistent with the majority vote of Pleasanton residents in 2000 favoring Measure D, staff
recommends that the City Council authorize the City Attorney to submit a letter to the
California Supreme Court asking that the Court grant review of the decision of the appellate
court, which decision too narrowly interpreted Measure D to the detriment of residents in

southeast Alameda County.

Respectfully
Submitted,

Michael H.
