WHEREAS, <br /> <br />cancelling the fees has been caused by the current land use designation of the <br />property (Planned Unit Development--Medium Density Residential/Open <br />Space/Vineyard District) and the land is not immediately suitable for any other <br />purpose for which a greater economic return to the landowner will be produced; <br />and <br /> <br />WHEREAS, <br /> <br />the Vineyard Avenue Corridor Specific Plan requires the planting of crops and <br />creation of conservation easements for agricultural purposes, which requirement is <br />entirely consistent with the purposes of the Williamson Act contract program to <br />conserve agricultural land; and <br /> <br />WHEREAS, <br /> <br />the Vineyard Avenue Corridor Specific Plan requires new development to be <br />clustered and limited in number, thereby protecting outlying agricultural land from <br />residential development; <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON: <br /> <br />Section 1. <br />Section 2. <br />Section 3. <br /> <br />The Pleasanton City Council waives the cancellation fee for Agricultural Preserve <br />Contract 1974-10B. <br /> <br />The Pleasanton City Council requests the Secretary of the State Resources Agency <br />also to approve the waiver of the fees. <br /> <br />This resolution shall become effective immediately upon its adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON AT <br />A MEETING HELD ON JANUARY 4, 2005 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - <br />NOES: None <br />ABSENT: None <br />ABSTAIN: <br /> <br />ATTEST: <br /> <br />APPROVED AS TO FORM: <br /> <br />Dawn Abrahamson, City Clerk <br /> <br />Michael H.
