THE CITY OF <br /> <br />pL£AS&NTONo <br /> <br />4P <br /> <br />City Council <br />Staff Report <br /> <br /> January 4, 2005 <br />City Attorney's Office <br /> Planning Department <br /> <br />SUBJECT: <br /> <br />WAIVER OF AGRICULTURAL PRESERVE (WILLIAMSON ACT) <br />CONTRACT FEES ON PROPERTY OWNED BY LONESTAR <br />CALIFORNIA WITHIN THE VINEYARD AVENUE CORRIDOR <br />SPECIFIC PLAN <br /> <br />STAFF RECOMMENDATION: <br /> <br />Adopt the attached resolution waiving the Williamson Act fees on about <br />21.5 acres within the Vineyard Avenue Corridor Specific Plan area and <br />request the State Resources Agency Secretary to approve the waiver. <br /> <br />SUMMARY: <br /> <br />Lonestar California owns property within the City of Pleasanton and <br />within the Vineyard Avenue Corridor Specific Plan area. That property <br />(totaling about 30 acres) is subject to a Williamson Act contract that <br />prohibits the residential development of the property. Lonestar has <br />requested that the City cancel the contract on about 21.5 acres located <br />south of the recently realigned Vineyard Avenue. When a contract is <br />cancelled, the landowner is required to pay to the State a cancellation fee, <br />12.5% of the cancellation value of the property. The cancellation fee, <br />however, may be waived if the city council makes certain f'mdings and the <br />waiver is thereafter approved by the State Resources Agency Secretary. <br />Lonestar has requested that the cancellation fee be waived. Staff believes <br />the necessary findings for waiving the fees can be made and the attached <br />resolution waives the cancellation fee. <br /> <br />SR:05:011 <br />Page 1 <br /> <br /> <br />
