CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 05- <br /> <br />RESOLUTION UPHOLDING THE APPEAL OF CASE PAP-72, THEREBY <br />APPROVING THE APPLICATION OF JAMES ERVIN FOR DESIGN <br />REVIEW APPROVAL, AS FILED UNDER CASE PDR-414 <br /> <br />WHEREAS, <br /> <br />James Ervin has applied for design review approval to construct a <br />single-story retail addition measuring 804 square feet to the front of an <br />existing residence located at 4473 Railroad Avenue; and <br /> <br />WHEREAS, zoning for the property is C-C (Central Commercial), Downtown <br /> Revitalization, and Core Overlay District; and <br /> <br />WHEREAS, <br /> <br />at its meeting of November 10, 2004, the Planning Commission, after <br />having considered all public testimony, relevant exhibits, and <br />recommendations of City staff concerning this application, denied the <br />application; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant <br /> submitted an appeal to the decision of the Planning Commission; and <br /> <br />WHEREAS, <br /> <br />at its meeting of January 4, 2005, the City Council received a report from <br />the Director of Planning and Community Development, together with a <br />copy of the staff report to the Planning Commission, regarding this matter; <br />and <br /> <br />WHEREAS, <br /> <br />the City Council held a public hearing on January 4, 2005, at which time <br />the applicant and any other member of the public was offered an <br />opportunity to present evidence regarding this appeal; and <br /> <br />WHEREAS, <br /> <br />after a review of the materials presented, the City Council determined that <br />the proposed design review, as conditioned, is appropriate and is consistent <br />with the zoning regulations for the zoning district of the property. <br /> <br /> <br />
