Adopt the draft resolution upholding the appeal, thereby approving Case PDR-414, <br /> subject to the conditions listed in Exhibit "B." <br /> <br />SUMMARY: <br /> <br />At issue is whether design review approval for Mr. James Ervin's proposed retail addition to his <br />existing residence should be granted. Both the Pleasanton Downtown Association (PDA) and <br />surrounding residents supported and encouraged the project (please see attached letter of support <br />from the PDA). The only suggestion submitted was the removal of the mullions from the front <br />windows to give the storefront addition a greater 'retail appearance.' The Planning Commission <br />denied the application (3-2 vote) due to concern over adding onto the front faCade of a building <br />of this age (104 years). Staff believes that the proposed addition, as conditioned, will be <br />compatible with the surrounding properties, retain the integrity of the historical building, <br />enhance the Downtown Revitalization District, and be appropriate for this site. <br /> <br />Honorable Mayor and Members of the City Council: <br /> <br />BACKGROUND <br /> <br />James Ervin, the owner of the residence at 4473 Railroad Avenue, applied for design review <br />approval to construct an approximately 804 square foot retail addition to the front of his home.~ <br /> <br />The Planning Commission reviewed and denied the application at its meeting of November 10, <br />2004. The applicant has appealed the Planning Commission's denial. The appeal is now before <br />the Council for final decision. <br /> <br />Please refer to the attached Planning Commission staff report, dated November 10, 2004, for <br />additional background information. <br /> <br />PROJECT DESCRIPTION <br /> <br />The applicant has proposed to construct an 804 sq. ft., single-story retail addition to the front of <br />an existing 1,933 sq. ft. single-family dwelling. The proposal includes paving the rear portion of <br />the lot to add three 9 ft. by 18 ft. parking spaces for retail use as required by the Pleasanton <br />Municipal Code. The existing, 17 ft. 6 in. wide driveway located along the south property line <br />would provide access to the proposed parking spaces. The applicant would continue to use the <br />property as his residence and would be the first tenant to occupy the proposed retail space for his <br />existing business: the San Francisco Cigar Company. <br /> <br />~ The staffreport to the Planning Commission stated the proposed floor area of the retail addition to be 768 sq. fi. However, <br />site plans as submitted show the floor area to be 804 sq. 1~.
