Page 1 of 6 <br />Item #4 <br /> <br />CIVIC ARTS COMMISSION <br />AGENDA REPORT <br /> <br /> <br />March 3, 2025 <br />Library and Recreation <br /> <br />TITLE: RECOMMEND CITY COUNCIL INTRODUCE AN ORDINANCE ADDING A NEW <br />CHAPTER 13.20 TO TITLE 13 OF THE PLEASANTON MUNICIPAL CODE <br />ESTABLISHING A PUBLIC ART CONTRIBUTION REQUIREMENT FOR <br />DEVELOPMENT AND ADOPT A RESOLUTION AMENDING THE CITY'S <br />MASTER FEE SCHEDULE TO ADD A PUBLIC ART CONTRIBUTION IN-LIEU <br />FEE <br /> <br />SUMMARY <br />The City of Pleasanton recognizes the important role of public art in fostering civic pride and <br />encouraging a sense of place. In August 2024, the City Council affirmed its interest in <br />establishing a public art contribution and alternative in-lieu fee to provide a sustainable source <br />of funds to acquire and maintain public art, and encourage provision of public art in new private <br />development projects. Unique or significant public art pieces can become landmarks people <br />associate with a community. With the support of generous benefactors, the City’s public art <br />collection has expanded over many years. Notably, these donations are specifically allocated <br />for the purchase of art and do not cover installation or maintenance of the artwork. By <br />implementing a public art contribution with an in-lieu fee alternative, the City could bolster its <br />public art collection by creating a continuous source of new art and an alternative funding <br />source for installing and maintaining public art, alongside the existing donor-advised funds, <br />which are projected to grow over time. Staff recommends the City Council adopt a resolution <br />introducing an ordinance adding a new chapter 13.20 to the Pleasanton Municipal Code (PMC) <br />and establishing a public art contribution with an in-lieu fee alternative. <br /> <br />RECOMMENDATION <br />Recommend City Council introduce an ordinance adding a new chapter 13.20 to Title 13 of the <br />PMC establishing a public art contribution requirement for development and adopt a resolution <br />amending the Master Fee Schedule to add a public art contribution in-lieu fee. <br /> <br />BACKGROUND <br />PMC Chapter 13.16 describes the purpose of Art in Public Places “to promote the acquisition, <br />construction, and installment of works of public art in Pleasanton that will foster creativity, <br />engender civic pride, encourage a sense of community, and enrich the lives of our citizens.” <br /> <br />The City has 46 permanent public art pieces, 19 utility box paintings, and three temporary <br />public art pieces. These works are located in City parks and facilities, as well as on public <br />streets and sidewalks, including areas around the Firehouse Arts Center, Alviso Adobe <br />Community Park, Pioneer Cemetery, and along Main Street. One public art piece is at Kaiser <br />Permanente Medical Facility on Stoneridge Drive. <br /> <br />Historically, the City's public art has been funded by the General Fund, an Internal Service <br />Fund, and a donor-advised fund, “Another H.A.P.P.Y.” (Another Harrington Art Partnership <br />Page 6 of 116
