ORDINANCE NO. 2289 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING AMENDMENTS TO CHAPTERS 3.22 — CAPITAL FACILITIES FEE, 3.26 <br /> — TRANSPORTATION DEVELOPMENT FEE, AND 14.04 — REGULATION OF WATER <br /> SYSTEM AND WATER SERVICE FEES OF THE PLEASANTON MUNICIPAL CODE <br /> WHEREAS, on November 3, 1998, the City Council of the City of Pleasanton adopted <br /> Ordinance 1764, adding Chapter 3.22 - Public Facilities Fee to the Pleasanton Municipal Code; <br /> and which chapter and fee was retitled in 2019 to the Capital Facilities Fee; and <br /> WHEREAS, on November 3, 1998, the City Council adopted Ordinance 1765, adding <br /> Chapter 3.26 - Traffic Development Fee to the Pleasanton Municipal Code; and which chapter <br /> and fee was retitled in 2019 to Transportation Development Fee; and <br /> WHEREAS, on August 8, 1966, the City Council adopted Ordinance 466 to establish <br /> connection charges for connection to the City of Pleasanton water system and related policies <br /> related to the extension of the system and developers obligations thereto; and which provisions <br /> have been amended and updated over time, and incorporated into the Pleasanton Municipal Code <br /> as part of Chapter 14.04 - Regulation of Water System and Water Service Fees; and <br /> WHEREAS,the City has undertaken a comprehensive update of the Capital Facilities Fee, <br /> Transportation Development Fee, and Sewer and Water Connection Fee, as detailed in the Fee <br /> Update and Nexus Study for the City of Pleasanton Development Impact Fee, Commercial <br /> Linkage Fee, and Affordable Housing In-Lieu Fee prepared by Economic and Planning Systems, <br /> and the City of Pleasanton Water and Wastewater Connection Fee Study prepared by Raftelis; <br /> and <br /> WHEREAS, on December 17, 2024, the City Council adopted the above-referenced nexus <br /> studies and amendments to the various fees; and <br /> WHEREAS, amendments to Chapters 3.22, 3.26, and 14.04 are necessary to align with <br /> the studies and to incorporate various technical amendments to provide consistency between the <br /> chapters, and clarify and update various administrative provisions of the various fees. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. Findings Pursuant to the California Environmental Quality Act(CEQA) <br /> The City Council finds the adoption of this Ordinance is not a project within the meaning of Section <br /> 15378 of the California Environmental Quality Act (CEQA) Guidelines because there is no <br /> potential for it to result in a physical change in the environment, either directly or indirectly, in that <br /> the various amendments pertain to administrative provisions of existing impact fees and metering <br /> of water connections. Additionally, it is also exempt from CEQA pursuant to CEQA Guidelines <br /> Section 15061(b)(3) because it can be seen with certainty that there is no possibility of a <br /> significant effect on the environment and contains no provisions that will directly or indirectly result <br /> in a physical change in the environment. <br /> SECTION 2. Approves the amendments to Pleasanton Municipal Code (PMC) Chapters <br /> 3.22 — Capital Facilities Fee; 3.26 — Transportation Development Fee; and 14.04 - Regulation of <br /> Water System and Water Service Fees. attached hereto as Exhibit A. <br />
