Exclusions of Section I – Coverage A – Bodily Injury And Property Damage <br />Liability, sub-paragraph (2) of exclusion g. Aircraft, Auto Or Watercraft is deleted and replaced by <br />the following: <br />(2) A watercraft you do not own that is: <br />(a) Less than 65 feet long, and <br />(b) Not being used to carry persons or property for a charge; <br />O) WAIVER OF TRANSFER OF RIGHTS OF RECOVERY AGAINST OTHERS TO US <br />Under Section IV – Commercial General Liability Conditions, the following is added to Condition <br />8. Transfer Of Rights Of Recovery Against Others To Us: <br />We will waive our right to recover all or part of any payment we have made under this Coverage <br />Part provided that prior to the loss you notify us in writing of: (1) your intention to waive any right <br />to recover; and (2) whom subrogation will be waived against. If your request meets our <br />underwriting criteria regarding such waivers, we will waive our right. However, we reserve the <br />right to charge additional premium or to limit the terms and conditions of such waiver. <br />P) WAIVER OF IMMUNITY <br />We will waive, both in the adjustment of claims and in defense of “suits” against the insured, any <br />charitable or governmental immunity of the insured, unless the insured requests, in writing, that <br />we not do so. <br />Waiver of immunity as a defense will not subject us to liability for any portion of a claim or <br />judgment, in excess, of the applicable limit of insurance. <br />Q) LIQUOR LIABILITY EXCLUSION – EXCEPTION FOR SPECIAL EVENTS OR FUNDRAISING <br />EVENTS <br />Under Paragraph 2. Exclusions of Section I – Coverage A – Bodily Injury And Property Damage <br />Liability, Exclusion c. Liquor Liability is amended by the addition of the following subparagraph: <br />However, this exclusion does not apply to “bodily injury” or “property damage” arising out of the <br />selling, serving or furnishing of alcoholic beverages at any special charitable events or fundraising <br />events hosted by the insured and related to the insured’s business, provided the insured has <br />obtained a license if such license is required to sell, serve or furnish alcoholic beverages. <br />R) EMPLOYEE CRIMINAL DEFENSE COVERAGE <br />1. If a “suit” is brought against the insured seeking damages because of “bodily injury”, “property <br />damage”, or “personal and advertising injury” to which this insurance applies, we will <br />reimburse the insured for reasonable and necessary legal expenses it incurs in the defense <br />of an “employee” in a criminal proceeding related to such “suit”.
