CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, ALAMEDA RESOLUTION NO. 04-098 RESOLUTION TO AUTHORIZE AGREEMENTS AND OTHER DOCUMENTS TO CARRY OUT THE CITY'S OBLIGATION TO PROVIDE MITIGATION FOR THE CALLIPPE PERSERVE GOLF COURSE AND OPEN SPACE PROJECT WHEREAS, the City of Pleasanton (City) is developing the Callippe Preserve Golf Course and Open Space Project (the Project) under a Streambed Alteration Agreement with the State Department of Fish and Game (Fish and Game); and WHEREAS, pursuant to the Streambed Alteration Agreement, the City, as mitigation measures for the Project, has agreed to provide a conservation easement to Fish and Game on the open space portion of the Project and to purchase a conservation easement on 107 acres of property adjacent to the Project owned by the Koopmann Family Trust (Koopmann); and WHEREAS, Koopmann has requested to convey the conservation easement on the Koopmann property to the California Rangeland Trust, a non-profit, public benefit corporation (CRT), which conveyance is acceptable to Fish and Game; and WHEREAS, under the Streambed Alteration Agreement, the City is required to provide certain easement monitoring services on the Koopmann property; and WHEREAS, CRT has agreed to provide these services on the City's behalf; and City is also to provide other mitigation measures for the Project, including the conservation easement on the open space portion of the Project mentioned above, an endowment to Fish and Game, and a letter of credit for the benefit of Fish and Game; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1. Section 2. The City Manager is authorized to sign an Agreement for Conservation Easement Monitoring Services, the final form of which shall be approved by the City Attorney. The City Manager, or the City Manager's designee, is authorized to sign all other documents, as necessary, to carry out the City's obligation to provide mitigation for the Project.
