CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 04-098 <br /> <br />RESOLUTION TO AUTHORIZE AGREEMENTS AND OTHER DOCUMENTS <br />TO CARRY OUT THE CITY'S OBLIGATION TO PROVIDE MITIGATION <br />FOR THE CALLIPPE PERSERVE GOLF COURSE AND OPEN SPACE <br />PROJECT <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton (City) is developing the Callippe Preserve Golf Course and Open <br />Space Project (the Project) under a Streambed Alteration Agreement with the State <br />Department of Fish and Game (Fish and Game); and <br /> <br />WHEREAS, <br /> <br />pursuant to the Streambed Alteration Agreement, the City, as mitigation measures for the <br />Project, has agreed to provide a conservation easement to Fish and Game on the open <br />space portion of the Project and to purchase a conservation easement on 107 acres of <br />property adjacent to the Project owned by the Koopmann Family Trust (Koopmann); and <br /> <br />WHEREAS, <br /> <br />Koopmann has requested to convey the conservation easement on the Koopmann <br />property to the California Rangeland Trust, a non-profit, public benefit corporation <br />(CRT), which conveyance is acceptable to Fish and Game; and <br /> <br />WHEREAS, under the Streambed Alteration Agreement, the City is required to provide certain <br /> easement monitoring services on the Koopmann property; and <br /> <br />WHEREAS, CRT has agreed to provide these services on the City's behalf; and <br /> <br />City is also to provide other mitigation measures for the Project, including the <br />conservation easement on the open space portion of the Project mentioned above, an <br />endowment to Fish and Game, and a letter of credit for the benefit of Fish and Game; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS <br />FOLLOWS: <br /> <br />Section 1. <br />Section 2. <br /> <br />The City Manager is authorized to sign an Agreement for Conservation Easement <br />Monitoring Services, the final form of which shall be approved by the City Attorney. <br /> <br />The City Manager, or the City Manager's designee, is authorized to sign all other <br />documents, as necessary, to carry out the City's obligation to provide mitigation for the <br />Project. <br /> <br /> <br />
