2 <br /> <br />ordinance in delivering affordable units; with mo difications to be evaluated to better <br />achieve that goal; and <br /> <br />WHEREAS, since its adoption, the Inclusionary Zoning Ordinance has resulted in <br />the production of hundreds of below-market-rate housing units in Pleasanton and <br />contributed a valuable source of funding to support the production of affordable housing <br />and programs that preserve access to and support affordable housing for Pleasanton <br />households; and <br /> <br />WHEREAS, in January 2024, the City retained professional services firm <br />Economic and Planning Systems (EPS) to provide analysis and recommendations with <br />respect to modification to the inclusionary rate and target affordability limits, and in this <br />particular respect to evaluate the feasibility of such changes with respect to the overall <br />production of market-rate residential units; and <br /> <br />WHEREAS, the City Council held public workshops on May 7, 2024 and August <br />20, 2024, to study potential amendments to the inclusionary rate and required <br />affordability levels as stated in the IZO, and consider and provide direction on various <br />potential amendments to the IZO; and <br /> <br />WHEREAS, on September 11, 2024, the Planning Commission held a duly- <br />noticed public hearing and considered the written agenda report, relevant exhibits, <br />direction from City Council and recommendations from City staff concerning this <br />application, and received testimony from interested parties; and <br /> <br />NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City <br />of Pleasanton, based on the entire record of proceedings, including the oral and written <br />staff reports and all public comment and testimony: <br /> <br />Section 1: Findings Pursuant to the California Environmental Quality Act (CEQA) <br />The adoption of this Resolution is not a project within the meaning of Section 15378 of <br />the California Environmental Quality Act (CEQA) Guidelines because there is no <br />potential for it to result in a physical change in the environment, either directly or <br />indirectly, in that the inclusionary ordinance is related only to the affordability of housi ng <br />and does not modify the physical characteristics of housing, or change or modify the <br />allowable density of projects. Additionally, it is also exempt from CEQA pursuant to <br />CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there <br />is no possibility of a significant effect on the environment and contains no provisions <br />that will directly or indirectly result in a physical change in the environment. <br /> <br />Section 2: The Planning Commission hereby recommends to the City Council approval <br />of Case No. P24-0505 for amendments to Pleasanton Municipal Code (PMC) Chapters <br />17.44 – Inclusionary Zoning; and related amendments to PMC Chapter 17.40 – <br />Affordable Housing Fee; Chapter 18.38 – Housing Opportunity Zone District; and the <br />Objective Design Standards for Housing Element Sites <br /> <br />Section 3: This resolution shall become effective 15 days following its passage. <br /> <br />Docusign Envelope ID: 08C02E88-17AB-4968-82AD-8CC9C436D349
