1 <br />AQUATIC CENTER RENTAL AGREEMENT <br />TRI VALLEY MASTERS <br /> <br /> <br />THIS AQUATIC CENTER RENTAL AGREEMENT is entered into September <br />1, 2024 by the CITY OF PLEASANTON, a municipal corporation (City), and the TRI <br />VALLEY MASTERS, a non-profit corporation (Masters). <br /> <br />RECITALS <br /> <br />WHEREAS, City owns an aquatic center complex, known as the Dolores Bengtson <br />Aquatic Center (DBAC), at 4455 Black Avenue in Pleasanton; and <br /> <br />WHEREAS, Masters is a Pleasanton-based organization which describes itself as <br />catering to anyone aged 18 to 100+ interested in becoming a better swimmer, rekindling <br />competitive spirit and enjoying working-out with others; and <br /> <br />WHEREAS, Masters desire to schedule time for its adult swim team members to use <br />the 50 meter pool at the DBAC; and <br /> <br />WHEREAS, Masters recognize City’s objective is to provide programs to meet a <br />variety of community swimming needs, pay for costs of operation, and if possible, provide <br />scheduled use for the Masters and other Pleasanton-based organizations; and <br /> <br />WHEREAS, City is willing to schedule pool time for Masters and its swimmers, <br />team members, coaches and affiliates (collectively TVMers) subject to certain conditions. <br /> <br />NOW, THEREFORE, in exchange for valuable consideration, the receipt of <br />which is hereby acknowledged, the parties hereto agree as follows: <br /> <br />1) Masters Use of 50 Meter Pool. <br /> <br />a) Scheduled Use. City is willing to provide TVMers with scheduled times for use of <br />the 50-meter lap pool at the DBAC. The scheduled pool times for use by the <br />Masters is more specifically set forth has Masters Lane Usage in Exhibit B for the <br />first year of this Agreement. Each subsequent August during the term of this <br />Agreement, City staff and Masters shall set a new Masters Lane Usage for the <br />following year (September 1 through August 31) in a revised Exhibit B. <br /> <br />i) Advance Notice of Cancelled Practice. Masters shall provide City’s <br />Recreation Supervisor with written email notice at <br />tnewman@cityofpleasantonca.gov of Masters practice cancellations at least <br />one week in advance so that City staff can alter staffing levels.
