2 <br />b) Swim Meets. Any Masters swim meets proposed for the DBAC shall be scheduled <br />as space is available, which shall be determined at City's discretion. For any <br />Masters swim meets, City and Masters shall coordinate in advance for additional <br />staffing, custodial services, radio rentals, food vending, extra garbage service, as <br />applicable, and a Conditions of Use Agreement; Masters acknowledges that extra <br />costs and services for Masters swim meets will be paid for by Masters. <br /> <br />c) Special Use. City or Masters may request, on a month-to-month basis and, when <br />possible, at least one-week advance notice to the other party, special uses of the <br />reserved pool space, including the following: <br /> <br />i) Additional Lanes. City may require additional lane space from time to time <br />for special aquatics classes, such as Water Safety Instructor (WSI) or <br />Lifeguard Training and City shall endeavor to provide adequate advance <br />notice to Masters. Masters agrees to reasonably accommodate such <br />requests. <br /> <br />ii) Annual Maintenance. City may close the DBAC for maintenance at least <br />one week each year. <br /> <br />iii) Unforeseen Closure. City reserves the right to cancel Masters scheduled use <br />and close all or a portion of the DBAC at any time to conduct emergency <br />mechanical or maintenance repairs. <br /> <br />iv) Other Uses. Other uses not defined at this time. <br /> <br />v) City Rights. The parties acknowledge that for special uses City has the <br />absolute right to use the 50-meter pool, even if during Masters scheduled use <br />times. <br /> <br />2) Rules for Use. Masters shall abide by all City rules as set forth in the Pleasanton <br />Municipal Code, City Council resolutions, as well as the DBAC Pool Rules as set <br />forth in Exhibit C, as may be amended in the discretion of City. <br /> <br />3) Term. This Agreement begins on September 1, 2024, and expires on August 31, 2025. <br /> <br />a) Agreement Renewal. City and Masters shall retain the right to renew this Agreement <br />for one additional one-year period. This is the second of three years for this <br />agreement. This Agreement may be renewed only by mutual agreement between the <br />parties. Each party retains the right to not renew the Agreement. <br /> <br />4) Fees. The fees for September 1, 2024, through August 31, 2025, are set forth in Exhibit <br />A. If the Agreement is renewed, rental fees for lanes and pool usage shall be increased <br />on the short course lane fee shown in Team Rental Rates (Exhibit A) on an annual basis by <br />Docusign Envelope ID: 661F3B0B-CAA6-4E4F-94AF-0DD332936F6D
