14 <br /> <br />Exhibit D <br /> <br />CONDITIONS OF USE <br />Dolores Bengtson Aquatic Center Tri Valley MASTERS <br /> <br />In order to facilitate use of the Dolores Bengtson Aquatic Center ("facility") and ensure a <br />safe and healthful environment for all concerned, the following conditions of use shall be <br />adhered to: <br /> <br />1) At no time can Masters be on the pool deck or in the water without certified lifeguards <br />present (as written in Section 7 of the agreement). <br /> <br />2) No TVMer shall be in the pool or on the pool deck until the TVMer's coach is <br />present and directly supervising the program or other use. <br /> <br />3) Before Masters coaches leave the facility, they shall completely clean up all areas of <br />the facility associated with Masters use. All equipment shall be put away as <br />instructed by City staff. <br /> <br />4) TVMers shall be subject to all Dolores Bengtson Aquatic Pool Rules found in <br />Exhibit C. Masters coaches shall be responsible for enforcing rules and conditions of <br />use with TVMers. Any failure to abide by the rules or conditions of use could be <br />grounds for immediate suspension of use of the facility by the Masters. <br /> <br />5) Masters shall manage pool cover removal and covering, except when use is <br />complementary to a City program. At no time shall anyone be allowed to swim or <br />otherwise be in the water with pool covers still on the pool. <br /> <br />6) Masters shall be responsible for the cost of any additional maintenance and custodial <br />services required due to damage or clean up resulting from Masters use. <br /> <br />7) Masters coaches and TVMers shall use locker rooms designated for the general <br />public.
