Page 1 of 5 <br />Item #3 <br /> CITY COUNCIL AGENDA REPORT <br /> <br />September 3, 2024 <br />Police <br /> <br />TITLE: ADOPT A RESOLUTION APPROVING AN UPDATE TO THE CITY'S MASTER <br />FEE SCHEDULE FOR THE PROCESSING, REVIEW, APPROVAL AND <br />ISSUANCE OF CONCEALED CARRY WEAPONS PERMITS <br /> <br />SUMMARY <br />The Alameda County Sheriff’s Office changed its policy and now will only accept Concealed <br />Carry Weapons (CCW) applications from individuals who reside in unincorporated Alameda <br />County; therefore, the Pleasanton Police Department is now required to process applications <br />for review, and the Chief of Police will now issue new, renewal, and modification/duplicate <br />CCW permits to Pleasanton residents. Adoption of the resolution by the City Council will allow <br />the Pleasanton Police Department to set a fee schedule and collect the associated fees related <br />to the processing, review, approval and issuance of a concealed carry weapons permit for <br />Pleasanton residents. There will be three types of concealed carry weapons permits issued by <br />the Pleasanton Police Department: standard (2 years), judicial (3 years), and reserve (4 <br />years). <br /> <br />RECOMMENDATION <br />Adopt a resolution approving an update to the City's Master Fee Schedule to allow for the <br />collection of reasonable fees related to the processing, review, approval, and issuance of <br />concealed carry weapons permits. <br /> <br />BACKGROUND <br />In response to the 2022 United States Supreme Court ruling in New York Rifle and Pistol <br />Association v. Bruen, which changed the factors an agency can permissibly consider when <br />reviewing an application for a Concealed Carry Weapon permit, California Penal Code <br />sections 26150 and 26155 now provide that a Sheriff of a county or the Chief or other head of <br />a municipal police department of any city, or city and county, shall issue or renew a permit to <br />carry a pistol, revolver, or other firearm capable of being concealed upon the person known as <br />a Concealed Carry Weapon permit (CCW). <br /> <br />Historically, the Sheriff of Alameda County accepted CCW applications from individuals who <br />reside within Alameda County and all the cities within the County. Recently, the Alameda <br />County Sheriff’s Office (ACSO) changed its policy and will only accept CCW applications from <br />individuals who reside in unincorporated Alameda County. The Pleasanton Police Department <br />is now required to process applications for review, and the Chief of Police will now issue new, <br />renewal, and modification/duplicate CCW permits to Pleasanton residents. <br /> <br />Under Penal Code section 26190, local agencies issuing a CCW permit may establish a fee <br />structure that reflects reasonable costs associated with the processing, issuance, and <br />enforcing of CCW permits. <br /> <br />Page 12 of 46
