3 <br /> <br /> <br />f. City and/its contractor will share project schedule at the beginning of the project <br />and coordinate schedule changes with the owner that may impact access to the <br />parking lot. <br /> <br />g. City's contractor to repair damaged irrigation within twenty-four (24) hours of being <br /> notified of the incident and make complete restoration within thirty (30) days. <br /> <br />h. The construction hours for the project will vary based on the allowable lane closure <br />time established by the City's Traffic Engineer. It is anticipated that both daytime <br />and nighttime working hours will be utilized to construct the project. In the event of <br />major changes to the construction working hours, the property owner will be notified <br />by City and/or contractor. <br /> <br />i. The contractor drive aisle designated in the Exhibit “A” shall be used for access <br />only and no parking nor staging will be permitted in the drive aisle. Construction <br />vehicle parking shall be permitted in Area A or B only. Parking Areas "A" or "B" <br />should be utilized only one at a time. No staging will be allowed in the Area "A". <br />The Area "B" shall be utilized as staging or laydown area. <br /> <br />j. Area "C" is for parking lot sealcoating and restriping shall only be utilized by <br />contractor during sealcoat & striping activities. No other work shall take place <br />impacting other areas of the parking lot and around 6111 Johnson Court building. <br /> <br />k. City will maintain and control the appearance of the sound wall from Hopyard <br />Road. From the back of the sound wall to the building edge will be the property <br />owner's responsibility including metal fence and gate. <br /> <br />l. City shall not permit any liens to be placed against the Property arising from the <br />work described in this Contract. <br /> <br />m. Upon completion of the work, City shall, at its expense, repair, replace or restore <br />any damage that the City, its employees or contractors caused to existing <br />improvements on the Property or any other property (real or personal) incident to <br />the work, to a condition of said property immediately prior to it being damaged by <br />City, its employees or contractors. <br /> <br />Owner understands and agrees that after completion of City’s work described herein Clause 6, said <br />facilities will be considered as Owner’s sole property and Owner will be responsible for its <br />maintenance and repair. <br /> <br />7. City Performed Work. All work done under this Contract shall conform to all applicable <br />building, fire and sanitary laws, ordinance, and regulations relating to such work, and shall be done in <br />a good and workmanlike manner. All structures, improvements or other facilities, when removed, and <br />relocated, or reconstructed by the City, shall be left in as good condition as found. <br /> <br />8. Indemnity and Insurance. City shall indemnify, defend and hold harmless the Owner from any <br />loss, claims, liability, or expenses, including reasonable attorney's fees and costs, for personal injury <br />or death, or property damage, arising out of or in connection with the activities of City, its employees <br />or contractors under this Agreement. <br /> <br /> <br />  Docusign Envelope ID: 05CC23D1-E69A-4074-ADBE-C79729A68E14
