EXHIBIT A <br />RECORDING REQUESTED BY <br />AND WHEN RECORDED RETURN TO: <br />City of Pleasanton <br />City Clerk's Office <br />123 Main Street <br />Pleasanton, CA 94566 <br />Recording Fees Exempt Pursuant to <br />Government Code § 27383 <br />ABOVE SPACE FOR RECORDER'S USE <br />PRE -ANNEXATION AND DEVELOPMENT AGREEMENT <br />FOR MERRITT PROPERTY AT 4141 FOOTHILL ROAD <br />THIS PRE -ANNEXATION AND DEVELOPMENT AGREEMENT ("Agreement') is made <br />and entered into in the City of Pleasanton on , 2024, by and between the <br />CITY OF PLEASANTON, a municipal corporation ("City'), and FOOTHILL BOULEVARD <br />HOLDING COMPANY, LLC, a California limited liability company ("Developer"), pursuant to the <br />authority of California Government Code §§65864 et seq. City and Developer are sometimes <br />referred to herein individually as a "Part}' and collectively as the "Parties." <br />RECITALS <br />1. Developer has a legal or equitable interest in certain undeveloped real property <br />located in the City of Pleasanton, County of Alameda, California consisting of approximately <br />46.30 acres, as more particularly described in DA Exhibit A-1 attached hereto, and as <br />diagrammed in DA Exhibit A-2 attached hereto (the "Annexation Property' or the "Project <br />Site"). Developer proposes to develop the Project Site with a 111 unit, age -qualified residential <br />community with 93 single-family detached homes (92 single-family detached homes and 1 <br />existing single-family detached home), 18 affordable senior alley -loaded and/or court -yard <br />detached and duet homes and related on-site and off-site improvements (the "Project'). <br />2. The Alameda County Local Agency Formation Commission ("LAFCO") is the local <br />agency responsible for designating the Sphere of Influence ("SOP') for the City and approving <br />changes to the boundaries of the City according to the Cortese -Knox -Hertzberg Local <br />Government Reorganization Act (Cal. Government Code §§56000 et seq.) (the "CKH Act'). It is <br />anticipated that LAFCO will approve annexation of the Annexation Property into the City in <br />2024. <br />3. The Project Site is located within the City's SOI, is designated as Low Density <br />Residential in the City's General Plan, and is identified in the City's 6th Cycle Housing Element <br />("Housing Element') as Site 22. To implement certain goals, policies and programs of the <br />Housing Element, the Project Site was pre -zoned Planned Unit Development — Low Density <br />Residential/Housing Opportunity Zone ("PUD-LDR/HOZ') on December 19, 2023 pursuant to <br />Ordinance No. 2259. <br />
