RESOLUTION NO. 2024-058 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> APPROVING THE ALTAMONT LANDFILL AND RESOURCE RECOVERY FACILITY <br /> OPEN SPACE ADVISORY COMMITTEE EXPENDITURE FOR A GRANT RELATED TO <br /> CONSERVATION EASEMENTS <br /> WHEREAS, as part of the Altamont Landfill Settlement Agreement among the County of <br /> Alameda, the Cities of Livermore and Pleasanton, the Sierra Club, the Northern California <br /> Recycling Association (NCRA), and Altamont Landowners Against Rural Mismanagement and <br /> Waste Management of Alameda County, Inc.(dated November 30, 1999), hereafter referred to <br /> as Settlement Agreement; provides for collection of a per ton fee from the Altamont Landfill and <br /> Resource Recovery Facility for impacts on the communities due to expansion of the landfill, and <br /> WHEREAS, pursuant to the Settlement Agreement, the County convened the Altamont <br /> Landfill Open Space Advisory Committee consisting of one member appointed by the Board of <br /> Supervisors, one member appointed by the Livermore City Council, one member appointed by <br /> the Pleasanton City Council, and one member appointed by the Sierra Club; and <br /> WHEREAS, the Settlement Agreement states that by approval of a majority of the <br /> members of the Advisory Committee and concurrence by the County and Cities, up to five <br /> percent of the funds received in any given year may be expended for the services of <br /> independent consultants to aid the Open Space Advisory Committee in carrying out its duties to <br /> identify open space areas in need of protection and to make plans for their acquisition; and <br /> WHEREAS, on May 17, 2024, the voting members of the Open Space Advisory <br /> Committee from both the east and west acquisition priority areas voted unanimously to <br /> authorize the expenditure of funds of$56,000 to the Alameda County Resource Conservation <br /> District (ACRCD) and the California Rangeland Trust (CRT) for an outreach program to solicit <br /> Alameda County ranchers/rural landowners on conservation easements, and <br /> WHEREAS, the additional expenditure of up to $56.000 for the program remains within <br /> the five percent of funds received annually allowed by the Settlement Agreement for such <br /> expenditures: and <br /> WHEREAS, in accordance with the Settlement Agreement, concurrence by the Cities of <br /> Pleasanton and Livermore. and the Alameda County Board of Supervisors is necessary to fund <br /> the proposed allocation from the Open Space Fund. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. The Pleasanton City Council does find the recommendation of the Altamont <br /> Landfill and Resource Recovery Facility Open Space Advisory Committee to approve an <br /> expenditure not to exceed $56,000 for services provided by ACRCD and CRT is consistent with <br /> the Altamont Landfill Settlement Agreement. <br /> SECTION 2. The City Clerk shall certify to the passage of this resolution and enter it into <br /> the book of original resolutions. <br />
