3 <br />Integra Construction Services, Inc. listed “Altamont Electric and Lighting, LLC.” as a <br />subcontractor to perform electrical work. According to the DIR PWCR Database, Altamont <br />Electric and Lighting, LLC’s PWCR (1001184725) expired on June 30, 2024, and has not yet <br />been renewed. <br />The City is legally obligated to award construction contracts to the “lowest responsive and <br />responsible bidder,” with only a few specific exceptions. The City has the authority to decide <br />whether a low bidder is “responsive.” According to § 1103, a responsive bidder is defined as one <br />whose bid adheres to the essential terms and conditions outlined in the invitation for bids, <br />including the specifications and requirements stated in the solicitation documents. <br />Integra Construction Services, Inc. is an experienced contractor and should be aware that, under <br />the Public Contract Code, is required to include only registered subcontractors in its bid for a <br />public works project. By listing a subcontractor without valid/active DIR public works <br />registrations (PWCR) in its bid, Integra Construction Services, Inc. has failed to comply with the <br />requirements, providing ample grounds to deem them a non-responsive bidder. <br />CONCLUSION <br />Thoroughly investigating issues of responsiveness and responsibility is central to the City's <br />fiduciary duty to its taxpayers. Given the issue described above, NCIC respectfully requests that <br />the City fulfill this responsibility by rejecting Integra Construction Services, Inc.'s bid for non- <br />compliance with Public Contract Code section 1103. <br />Should the City determine that Integra Construction Services, Inc.'s bid is non-responsive or that <br />the company is not a responsible bidder, the City must either award the Project to the next <br />responsive and responsible bidder, Guerra Construction Group, or reject all bids and initiate a <br />new bidding process. Please respond to this bid advisory by August 20th, 2024, indicating the <br />steps the City will take to meet its fiduciary obligations and ensure compliance with state <br />competitive bidding laws. <br />Thank you for your time and consideration of this critical matter. <br />Sincerely, <br />Matt Hilliard <br />Sr. Compliance Agent
