EXHIBIT A <br />DRAFT CONDITIONS OF APPROVAL <br /> <br />PUD-18-07M <br />3450 Mohr Avenue <br />June 12, 2024 <br /> <br /> <br />The applicant is hereby notified, as part of this approval, that (s)he is required to satisfy and maintain <br />compliance with the conditions of approval below. Where approval by the Director of Community <br />Development, Planning Division, Director of Engineering/City Engineer, City Attorney, Chief Building and <br />Safety Official, Fire Department or other City staff is required, review shall be for compliance with all <br />applicable conditions of approval, adopted policies and guidelines, ordinances, laws and regulations, and <br />accepted practices related to the approval. In addition to complying with the conditions below, the <br />applicant is required to comply with all applicable federal, state, and local laws that pertain to this project <br />whether or not specifically noted herein. <br /> <br />This approval is granted for a Planned Unit Development Major Modification to 1) subdivide an <br />approximately 1.4-acre parcel located at 3450 Mohr Avenue into two parcels measuring approximately <br />44,237 square feet (Lot 1) and approximately 17,123 square feet (Lot 2), and 2) construct an <br />approximately 2,288-square-foot addition to the existing residence on Lot 1 located on Assessor Parcel <br />No(s). (946-4604-1) at 3450 Mohr Avenue. Development shall be substantially as shown on the project <br />materials listed below: <br /> <br />a. Project plans, Exhibit B, prepared by AJS Architecture & Planning for Anurag Jain dated <br />“Received” on 4-9-2024 and kept on file in the Planning Division of the Community Development <br />Department. <br /> <br />b. Vesting Tentative Parcel Map 11413 by Alexander & Associates Inc. dated 4-8-2024 <br /> <br /> <br />THIS APPROVAL IS GRANTED SUBJECT TO THE FOLLOWING CONDITIONS: <br />1. APPROVAL AND REVISIONS: The proposed development shall be in substantial conformance <br />with the “Approved Plans”, except as modified by the following conditions. Minor changes to the <br />plans may be allowed subject to the approval of the Director of Community Development if found <br />to be in substantial conformance with the approved exhibits. Planning Division approval is <br />required before any changes are implemented in site design, grading, architectural design, house <br />colors or materials, green building measures, landscape material, etc. <br /> <br />2. EXPIRATION – RESIDENTIAL PUD: The PUD development plan shall lapse two years from the <br />effective date of this ordinance unless a final or parcel map, as applicable, is approved. If a final <br />or parcel map is approved, the PUD development plan approval shall lapse when the final or <br />parcel map approval expires. If the map is recorded before the final or parcel map expires, then <br />the PUD development approval shall not lapse. <br /> <br />3. EXPIRATION – DESIGN REVIEW: This design review approval shall lapse 1 year from the <br />effective date of approval unless a building permit is issued and construction has commenced <br />and is diligently pursued towards completion, or the City has approved a time extension. <br /> <br />4.
