Resolution No. 2024-052 Page 2 of 2 • The Public Service Easement to be summarily vacated was granted across Lot 6 of Tract Map 6275 (Book 199 of Maps at Pages 51 through 54) as accepted by the City Clerk and as described in detail in the Quitclaim of Public Service Easement across 4035 Equus Court to be recorded together with this Resolution. • A replacement Public Service Easement will be granted by 1400 Foothill LLC in the same general location. • This Resolution is prima facie evidence that the Public Service Easement is determined to be excess. • That from and after the date this Resolution is recorded, the vacated Public Service Easement no longer constitutes a street, highway, or public service easement. • That all entities having any right, title, or interest in the Public Service Easement being vacated have been notified of this action. SECTION 2. The City Manager shall execute the Quitclaim of Public Service Easement across 4035 Equus Court as authorized by this Resolution. SECTION 3. The City Clerk shall cause a certified copy of this Resolution, as attested under seal, to be recorded without acknowledgment, certificate of acknowledgment, or further proof in the office of the Alameda County Recorder together with the fully executed Quitclaim of Public Service Easement across 4035 Equus Court. SECTION 4. The City Manager shall accept the replacement Public Service Easement according to the authority granted by City Council Resolution No. 89-31 PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on July 16, 2024.
