SECTION 19. APPLICATION FOR FRANCHISE: (a) Application for a franchise hereunder shall be filed with the City Clerk in a fom approved by the City and shall contain the follo~ng info~a- riCh: 1. The nam~ and address of applicant. 2. A general description of applicant's proposed CATV operation, including map of areas to be served. 3. A statement or schedule in a form approved by the City of proposed rates and charges to subscribers for installation and setwices, and a copy of proposed service agreement betveen the grantee and its subscribers shall accompany the application. For unusual circmnstances, such as underground cable required, or more than 150 feet of distance from cable to connection of service to subscribers, an additional installation charge over that normally charged for in- stallation as specified in the applicant's proposal may be charged, with easements to be supplied by subscribers. For remote, relatively inaccessible subscribers urlthin the City, service ~rill be made available on the basis of cost of materials, labor, and easements if required. 4. A statement of the corporate organization of applicant, including the names and addresses of its officers, directors and associates, and also including the names of subsidiary companies with a listing of other areas being served by CATV or similar systems. 5. A statement setting forth all agreements and understandings, whether written, oral or implied, existing between the applicant and any person, firm, group or corporation with respect to the franchise and the proposed opera- tions. 6. Applicant shall also furnish a financial statement as to the company's or corporation's financial ability to complete installation and opera- tion of the CAZV system. (b) Upon consideration of any such application, the City Council may grant a franchise for CATV to such applicant as may appear from said applica- tion to be in its opinion best qualified to render proper and efficient CATV service to television viewers and subscriber~ in the City. The Council's decision in the selection viii be final. (c) Any franchise issued pursuant to this Ordinance shall include the follo~ing condition: '~he CATV system hereiu franchised shall be used and operated solely and exclusively for the purpose expressly authorized by Ordinance of the City of Pleasanton and no other purpose whatsoever." The inclusion of the foregoing statement in any such franchise shall not be deemed to limit the authority of the City to include any other reasonable condition, limitation or restriction which it may deem necessary to impose in connection wtth such f~anchise pursuant to the authority conferred by this Ordin- ances SECTION 20. ~FECTIVEDATE. This ordinance shall become effective thirty days from and after its adoption. SECTION 21. PUBLICATION. The City Clerk is hereby directed to cause this ordinance to be published by one insertion in '~he Times", a daily newspaper of general circulation printed, published and circulated in the City of Pleasanton.
