2022534, Second Amendment Page 1 <br />SECOND AMENDMENT TO AGREEMENT <br />This Second Amendment to Agreement ("Second Amendment") is entered into this 1st day of July <br />2024 by the City of Pleasanton ("City") and Tree Sculpture Group, Inc ("Contractor”). <br />Whereas, on July 1, 2022, the City and Contractor entered into a Maintenance Services <br />Agreement for landscape maintenance services and amended the agreement on July 1, 2023 <br />("Agreement"); and <br />Whereas, the parties now seek to extend the term of the agreement by one year and agree that <br />compensation may be increased for inflation as allowed by the Agreement; <br />Whereas, the parties agree that Basic Maintenance work shall be removed from the agreement <br />for 1993-1 (Windsor). <br />Now, therefore, in exchange for valuable consideration, the receipt of which is hereby <br />acknowledged, the parties agree as follows: <br />1.Section 1 of the Agreement, “Term and Schedule” is amended to extend the term of the <br />agreement for one (1) additional year to June 30, 2025. <br />2.Section 3 of the Agreement, “Compensation” is amended as follows: <br />a.Exhibit A – “Scope of Work”, page 3, shall be amended as indicated in the attached <br />Exhibit A for a total compensation of $124,642 for the extended contract term period. <br />b.The annual compensation for weed abatement is increasing 1.1% (The Engineering News <br />Record Construction Cost Index for San Francisco, average from April 2023 to April <br />2024). <br />c.The annual compensation for General Benefit Maintenance for 1984-1 (Ponderosa-Del <br />Prado) is increasing 1.1% <br />d.The annual compensation for Basic Maintenance for 1984-1 (Ponderosa-Del Prado), <br />1994-1 (Oak Tree Farm), and 1995-1 (Moller Ranch) is increasing 1.1% <br />e.The annual compensation for Basic Maintenance for 1993-1 (Windsor) has been removed <br />from the contract. <br />f.The annual compensation for Basic Maintenance for 1993-2 (Bonde Ranch) remains <br />unchanged. The amount of work performed shall be the amount shown in Exhibit A with <br />hours of work performed based on the fee schedule in Exhibit B. <br />g.The annual compensation for Extra Work for 1984-1 (Ponderosa-Del Prado), 1993-1 <br />(Windsor), 1993-2 (Bonde Ranch), 1994-1 (Oak Tree Farm), and 1995-1 (Moller Ranch) <br />has been modified.
