Exhibit D <br />Conditions of Approval <br /> <br />PUD-81-25-6M, Fairland Investment, Inc. <br />3121 Bernal Avenue and 3581 Utah Street <br />November 2, 2004 <br /> <br />All conditions of Case PUD-81-25 and PUD-81-25-1M through PUD-81-25-5M <br />shall remain in full force and effect, except that the sale of beer and wine shall <br />only be allowed as a conditional use from the convenience market operating in <br />conjunction with a gasoline service station. <br /> <br />This PUD development plan modification shall lapse within two-years from the <br />effective date of the City Council's approval unless a building permit is issued and <br />construction has commenced and is diligently pursued toward completion or an <br />extension has been approved by the City. <br /> <br />{end} <br /> <br /> <br />
