RESOLUTION NO. PC-2024-12 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />APPROVING THE APPLICATION FOR CONDITIONAL USE PERMIT (CUP) LOCATED AT <br />6689 OWENS DRIVE, SUITE 500, AS FILED UNDER CASE NO. P24-0291 <br />WHEREAS, on April 26, 2024, Andrew Hamel, representing Prodigy Sports <br />Performance, Inc., applied for CUP approval to operate a gymnasium with a maximum of 20 <br />members on-site at any one time located at 6689 Owens Drive, Suite 500 (hereinafter <br />“project”); and <br />WHEREAS, the subject property is zoned PUD-I/C-O (Planned Unit Development – <br />Industrial/Commercial-Office) District; and <br />WHEREAS, a gymnasium is a conditionally permitted use in the subject’s zoning district <br />and requires Planning Commission approval of a CUP; and <br />WHEREAS, on June 12, 2024, the Planning Commission held a duly-noticed public <br />hearing and considered relevant exhibits, recommendations of the City staff concerning this <br />application, and received testimony from the applicant and interested parties. <br />NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of <br />Pleasanton, based on the entire record of proceedings, including the oral and written staff <br />reports and all public comment and testimony: <br />Section 1: Findings for California Environmental Quality Act (CEQA) <br />With respect to CEQA, the Planning Commission finds the project is categorically exempt from <br />CEQA pursuant to CEQA Guidelines Section 15301, Class 1, Existing Facilities. The proposed <br />business will operate in an existing facility and no interior or exterior modifications are <br />proposed. <br />Section 2: Findings for Conditional Use Permit Approval <br />With respect to the approval of P24-0291, the Planning Commission makes the following <br />findings as required by Section 18.124.070 of the Pleasanton Municipal Code: <br />A.That the proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which the <br />site is located. <br />Some of the objectives of the zoning ordinance are to: foster a harmonious, convenient, <br />workable relationship among land uses, protect existing land uses from inharmonious <br />influences and harmful intrusions, and to ensure that public and private lands ultimately <br />are used for the purposes which are most appropriate and beneficial to the City as a <br />whole. The subject building is located in a business park land use setting, and zoned <br />PUD I/C-O, which allows a variety of office, commercial, R&D, and light industrial uses. <br />Based on this wide range of uses, the Planning Commission believes this location is <br />EXHIBIT A
