Resolution No. 2024-035 <br />Page 2 of 2 <br />WHEREAS, on May 21, 2024, the Pleasanton City Council held a duly noticed public <br />hearing on this application and considered all public testimony, agenda reports, and related <br />materials, and the recommendation of City staff; and <br />WHEREAS, denial of a project is not an action subject to the California Environmental <br />Quality Act (CEQA). <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER THE <br />FOLLOWING: <br />SECTION 1: The City Council upholds the Planning Commission's decision denying the <br />applications for Design Review and Vesting Tentative Map (Case No. P23-0599) because the <br />Hacienda PUD designates the subject site as Garden Office (OGPD), which does not permit <br />residential development except for Nursing Homes/Assisted Living Facilities. <br />SECTION 2: City Clerk shall certify to the passage of this resolution and enter it into the <br />book of original resolutions. <br />PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br />a regular meeting held on May 21, 2024. <br />I, Jocelyn Kwong, City Clerk of the City of Pleasanton, California, certify that the foregoing <br />resolution was adopted by the City Council at a regular meeting held on the 21St day of May, 2024, <br />by the following vote: <br />Ayes: Councilmembers Arkin, Balch, Nibert, Testa, Mayor Brown <br />Noes: None <br />Absent: None <br />Abstain: None <br />Jocel n K ng, City Clerk <br />X <br />OVED S TO FORM. <br />Daniel G.
