O'Grady Paving , In c. . l o lh <br />City of Pleasanton, City Clerk, 123 Main Street, Pleasanton , California (hereinafter called <br />"City"). <br />Ladies and Gentlemen: <br />T he Bidder, in compliance with the invitation for bids for the ANNUAL STREET <br />RESURFACING & PREVENTATIVE MAINTENANCE, PROJECT NO. 24503, <br />City of Pleasanton, having examined the Plans and Specifications and related documents <br />and the premises of the proposed work, and being familiar with all of the conditions <br />surrounding the construc6on of the proposed project including the availability of <br />materials and supplie s , declares that this proposal is made without collusion with any <br />other person , firm or corporation and agrees to construct the project in accordance with <br />the contract documents, wi thin the time set forth therein, and at the prices stated below. <br />These prices are to cover all expenses incurred in performing the work required under the <br />Contract Documents, of which this Bid Proposal is a part. <br />T he project has two distinct Liquidated Damages <br />1) Preventative Maintenance Liquidated Damages (Milestone #1) <br />The Bidder shall agree to complete all work required and specified for Preventative <br />Maintenance (base repairs and crack sealing on streets shown on sheet G-3 Preventative <br />Maintenance Schedule) to be completed no later than August 16, 2024. The City will be <br />awarding the contract on April 16, 2024 and will issue the Notice to Proceed no later than <br />May 15, 2024. Bidder shall pay liquidated damages in the sum of $2,500 per working <br />day should the successful Bidder fail to complete the required work of Milestone #1 as <br />described herein. <br />2) General Contract Liquidated Damages. <br />Bidder shall agree to comme nce work under this Contract within fifteen (15) calendar <br />days after the date of written "Notice to Proceed'1 and fully complete the project within <br />one hundred twe nty-five (115) working days after start of work.
