Resolution No 2024-023 <br />Page 2 of 2 <br />SECTION 1. Finds that the Consistency Checklist for the 55 -Unit Project and the <br />Affordable Housing Agreement is in conformance with the analysis and conclusions of the <br />Pleasanton General Plan 2005-2025 ("General Plan") Program Environmental Impact Report ("EIR") <br />(State Clearinghouse No. 205122139) and qualifies for an exemption from additional environmental <br />review under CEQA Guidelines Section 15183 because the 55 -Unit Project and the Affordable <br />Housing Agreement are consistent with the development density and land use characteristics <br />established by the City as analyzed by the General Plan EIR. <br />SECTION 2. Finds that the proposed Affordable Housing Agreement between the City and <br />Catalyst is consistent with the City's General Plan and the objectives of the City's affordable housing <br />polices, including fulfilling the requirements of Municipal Code Chapters 17.40 Affordable Housing <br />Fees and 17.44 Inclusionary Zoning. <br />SECTION 3. Approves an Affordable Housing Agreement between the City and Catalyst <br />which: restricts the eight (8) affordable units to be sold to qualified median -income (100% AMI) <br />households or housing providers; provides that Catalyst shall receive $375,000 per affordable <br />unit; the City Council allocates up to $250,000 in Affordable Housing Funds (Account 12230700) <br />to be made available, if needed, to pay the difference between the affordable housing cost <br />purchase price for a qualified median -income buyer and the $375,000 price payable to Catalyst; <br />these funds are to be available to pay such difference for five (5) years following issuance of a <br />building permit for the project; such funds, if unused, shall be returned to the Affordable Housing <br />Fund (Account 12230700); a copy of the Affordable Housing Agreement is attached hereto as <br />Exhibit A and incorporated herein by this reference; and authorizes the City Manager to execute <br />the Affordable Housing Agreement in generally the form attached as Exhibit A, subject to <br />amendments and the approval by the City Attorney. <br />SECTION 4. Allocates $250,000 from the Affordable Housing Fund (Account 12230700) <br />for the purposes described herein. <br />SECTION 5.
