Location and Notification Map STAFF RECOMMENDATION Staff recommends the Planning Commission approve the amendment to the original Conditional Use Permit (CUP) application (PCUP-61), filed as P24-0127, based on the required findings, and subject to the draft conditions of approval in Exhibit A. EXECUTIVE SUMMARY The applicant requests to expand the range of alcoholic beverages offered for sale at an existing gas station market at 1875 Valley Avenue from the approved beer and wine to include distilled spirits and ready-to-serve beverages. Concerns about alcohol sales and associated late-night noise were expressed by neighbors of the property in March 2004 after the existing gas station market began operating, and at a July 2004 public hearing, the Planning Commission considered a request from neighbors to modify the Use Permit.
