RESOLUTION NO. PC-2024-06 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON APPROVING A DAYCARE FACILITY FOR L’ACADEMY <br />SCHOOL LOCATED AT 5675 OWENS DRIVE, FOR A MAXIMUM OF 128 <br />PEOPLE AT ONE TIME, AS FILED UNDER CASE NO. P24-0110 <br />WHEREAS, on February 14, 2024, Nora Collins of AvalonBay Communities <br />submitted an application for Conditional Use Permit (CUP) application on behalf of <br />L’Academy School to operate a daycare facility with a maximum of 110 children and 18 <br />staff members at one time; <br />WHEREAS,the General Plan land use designation for the property is Business <br />Park and Mixed Use; and <br />WHEREAS, zoning for the property is PUD-HDR (Planned Unit Development – <br />High-Density Residential) District; and <br />WHEREAS, the project is located in Hacienda Business Park; and <br />WHEREAS, the entirety of the project including residential and commercial <br />components was previously analyzed pursuant to CEQA (State Clearinghouse Number <br />20110520002 for the Residences at California Center Project/PUD-85-8-ID-4M); the <br />proposed daycare use would not cause any impacts different to or in excess of those <br />previously analyzed. The use would occur within a fully entitled and permitted building, <br />and as such would also be categorically exempt from the California Environmental Quality <br />Act (CEQA) pursuant to Section 15301, (Existing Facilities), since the project would not <br />result in the expansion of the previously approved building and/or would be limited to <br />interior alterations of the existing building. Therefore, no additional environmental review <br />is required; and <br />WHEREAS, on April 10, 2024, the Planning Commission held a duly-noticed public <br />hearing, considered relevant exhibits, recommendations of the City staff concerning this <br />application, and received testimony from the applicant and interested parties. <br />NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City <br />of Pleasanton, based on the entire record of proceedings, including the oral and written <br />agenda reports and all public comment and testimony: <br />Section 1: Findings for Conditional Use Permit Approval <br />With respect to the approval of P24-0110, the Planning Commission makes the following <br />findings as required by Section 18.124.070 of the Pleasanton Municipal Code: <br />A. That the proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located.
