Page 1 <br />EXHIBIT A <br />DRAFT CONDITIONS OF APPROVAL <br />P23-0177, Tract 8672 <br />3200 Hopyard Road <br />February 28, 2024 <br />The applicant is hereby notified, as part of this approval, that (s)he is required to satisfy and <br />maintain compliance with the conditions of approval below. Where approval by the Director of <br />Community Development, Planning Division, Director of Engineering/City Engineer, City Attorney, <br />Chief Building and Safety Official, Fire Department or other City staff is required, review shall be for <br />compliance with all applicable conditions of approval, adopted policies and guidelines, ordinances, <br />laws and regulations, and accepted practices related to the approval. In addition to complying with <br />the conditions below, the applicant is required to comply with all applicable federal, state, and local <br />laws that pertain to this project whether or not specifically noted herein. <br />This approval is granted for a Design Review (P23-0177) and Vesting Tentative Map 8672 approval <br />pursuant to SB 330 to: 1) demolish an existing church and daycare facility; 2) construct a housing <br />development consisting of 57 units comprised of 48 three-story townhome-style condominiums <br />ranging in size from approximately 1,691 to 2,738 square feet, nine apartment units, and related <br />site improvements; and 3) Vesting Tentative Map located on Assessor Parcel No(s). 941-0907-062 <br />at 3200 Hopyard Road. Development shall be substantially as shown on the project materials listed <br />below: <br />a.Project plans, Exhibit B, Vesting Tentative Tract Map 8672 by MacKay & Somps, <br />Architectural Plans by WHA Architects, and Landscape plans by Ripley Design, dated <br />“Received” on September 5, 2023, and kept on file in the Planning Division of the <br />Community Development Department. <br />b.ALTA/NSPS Land Title Survey by MacKay & Somps, dated September 16, 2023, and kept <br />on file in the Planning Division of the Community Development Department. <br />c.Lighting Plan - Photometric Analysis by Associated Lighting Representatives, dated October <br />6, 2023, and kept on file in the Planning Division of the Community Development <br />Department. <br />d.Arborist Report prepared by Buena Vista Tree Service for Catalyst Development Partners <br />LLC, dated May 2023, and kept on file in the Planning Division of the Community <br />Development Department. <br />e.Tr affic Technical Memorandum prepared by TJKM Transportation Consultants for Catalyst <br />Development Partners LLC, dated January 2, 2024, and kept on file in the Planning Division <br />of the Community Development Department. <br />f.Geotechnical Investigation Report by Cornerstone Earth Group for Catalyst Development <br />Partners LLC, dated September 27, 2022 (revised August 30, 2023) (Project No. 1380-1-1), <br />and kept on file in the Planning Division of the Community Development Department. <br />EXHIBIT A <br />ATTACHMENT 1
