The City may, in its sole discretion, elect to <br />defend any such action with attorneys of its choice. <br /> <br />PLANNING DIVISION – 925-931-5600 <br /> <br />Conditional Use Permits <br /> <br />3. ORIGINAL APPROVAL: All Conditions of Approval listed in Planning <br />Commission Resolution No. 02-100 shall remain in full force and effect except as <br />modified below: (Project specific condition) <br />a. Beer, wine, and ready to serve beverages cannot be displayed within five <br />feet of the cash register or front door unless it is being stored in a <br />permanently located cooler; <br />b. All distilled spirits, not including ready to serve beverages, will be <br />displayed behind the cashier; <br />c. No alcohol will be sold between the hours of 12:00 a.m. and 6:00 a.m.; <br />d. Alcohol may not be displayed from an open ice-tub; <br />e. The applicants shall maintain a clear line-of-sight from the cash registers <br />to the shelves storing the beer, wine, and ready to serve beverages; <br />f. Policy signs will be posted on premises: “No Open Containers”, “No <br />Consumption of Alcoholic Beverage on the Premises”, and “No Loitering”; <br />g. No exterior advertising or window signs will advertise alcohol products; <br />h. No fortified wines or malt liquor will be sold; <br />i. Cooler doors containing alcohol will be locked from 12:00 a.m. to 6:00 <br />a.m. nightly; <br />j. All persons that appear younger than 30 years old must provide ID in <br />order to purchase alcohol; and <br />k. ID must be scanned through the point of sale system to validate age. No <br />alcohol will be sold if customer is a minor. <br /> <br />4. MODIFICATIONS: If additional hours of alcohol sales and/or any other significant <br />changes beyond what is stated in the “Approved Plans” are desired, City review <br />and approval is required prior to making said changes/modifications. The <br />applicant shall submit any proposed changes/modifications in writing. The <br />Director of Community Development may approve the modification or refer the <br />matter to the Planning Commission if judged to be substantial. <br /> <br />5. CONDITIONAL USE PERMIT REVIEW: If the operation of this use results in <br />conflicts pertaining to parking, noise, traffic/circulation, or other factors, at the <br />discretion of the Director of Community Development, this conditional use permit <br />may be submitted to the Planning Commission for their subsequent review at a <br />public hearing.
