Resolution No. PC-2024-06 <br />Page Two <br /> <br />One of the primary concerns in reviewing a CUP application is the effect of the <br />proposed use on surrounding uses. The Land Use Element of the General Plan <br />designates the subject property as “Business Park (Industrial / Commercial and <br />Office).” The zoning for the project site is PUD-HDR (Planned Unit Development <br />– High Density Residential) District. It conditionally permits land uses such as <br />daycare centers. If the CUP is approved, the proposed childcare facility would be <br />consistent with the zoning district. <br /> <br />W hen the proposed use is educational, instructional, recreational, or daycare, <br />staff evaluates how that use integrates into the surrounding uses. The uses <br />immediately surrounding the site include office, light industrial/warehouse, public <br />and private schools, and residential. In the past, the Planning Commission has <br />granted Conditional Use Permits for preschool facilities in business parks <br />including Safari Kid at 6646 Willow Road, Crosspoint Church preschool at <br />5627 Gibraltar Drive, Little Ivy League at 4160 Hacienda Drive, Global Village <br />School at 4807 Hopyard Road, Pleasanton Bilingual Montessori School at 5724 <br />W. Las Positas Boulevard, and Empire Montessori at 5950 Stoneridge Drive. <br />These preschools have been operating without any apparent adverse impacts on <br />the surrounding businesses or residents since no complaints have been reported <br />to the City. Staff does not expect the proposed use would create any adverse <br />impacts on the surrounding uses if it is operated in conformance to the conditions <br />of approval. As discussed and analyzed in the agenda report, with off -site <br />parking arrangement for daycare staff parking, the subject site would have the <br />needed on-site parking for the proposed use and the activities occurring at the <br />facility are not expected to generate significant noise levels. Children would be <br />supervised at all times, both inside the facility and in the play area. The pla y area <br />is located on the northeast side of the buildings, away from the street(s). <br />Additionally, the proposed facility could provide convenient childcare services to <br />nearby residential uses. Based on this analysis, the Planning Commission finds <br />the proposed use would be compatible with the surrounding uses. Therefore, this <br />finding can be made. <br /> <br />B. That the proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />As conditioned, the Planning Commission finds the proposed daycare facility <br />would make a good neighbor, based on the play area location and off -site <br />parking arrangement which will help alleviate parking and traffic impacts. In <br />addition, the Health Risk Assessment prepared by ESA for the proposed use <br />finds the daycare facility and play area would not be exposed to significant health <br />risks from existing sources of air pollution and the health risk would be below <br />BAAQMD thresholds.
