The design of the proposed subdivision or type of improvements is not likely to <br /> cause serious public health problems. <br /> The proposed subdivision meets all applicable City standards pertaining to public health, <br /> safety, and welfare (e.g., standards pertaining to public utilities and services, public road <br /> design and traffic safety, fire hazards and noise hazards). All public safety measures are <br /> addressed through the design and conditions of approval for P23-0177 and the Vesting <br /> Tentative Map. The street design is satisfactory to the Livermore-Pleasanton Fire <br /> Department and City Traffic Engineer. The condominium units will be required to meet the <br /> requirements of the California Building Code, Fire Code, and other applicable City codes <br /> and/or requirements. The site is free from toxic or hazardous materials and no <br /> earthquake, landslide, flooding, or other natural hazards exist at this site. <br /> 7. The design of the subdivision or its related improvements will not conflict with <br /> easements, acquired by the public at large, for access through or use of property <br /> within the proposed subdivision. <br /> The Vesting Tentative Map will maintain the existing City's water pipeline easement <br /> located on-site. This Vesting Tentative Map provides for easements including a public <br /> access easement, public service easement and emergency access easement. The design <br /> of the subdivision and related improvements does not conflict with the proposed <br /> easements. <br /> 8. The restriction on approving a tentative subdivision map on land covered by a land <br /> conservation contract entered into pursuant to the California Land Conservation <br /> Act of 1965 (Williamson Act) is not applicable. <br /> The site is not covered by any land conservation contract, including a Williamson Act <br /> contract. <br /> 9. The discharge of waste from the proposed subdivision would not result in violation <br /> of existing requirements prescribed by the California Regional Water Quality <br /> Control Board (RWQCB). <br /> No discharge violation currently exists and sewer capacity is available for this subdivision. <br /> The Project would not discharge any waste other than domestic sewage and all sewage <br /> would be discharged into the city's sanitary sewer system for ultimate treatment. <br /> Stormwater runoff would be collected and conveyed through bio-retention basins. Urban <br /> stormwater runoff is required to meet the City's RWQCB permit requirements for urban <br /> development. <br /> Findings Pursuant to Government Code Section 65863 (No Net Loss) <br /> The Project includes 47 above-moderate income units and 8 moderate-income units; in <br /> comparison, the inventory of sites included in the 6th Cycle Housing Element projected that this <br /> site (listed as APN 941 090706200 in Table B-14)would provide up to 44 moderate income units. <br /> The project would provide 47 more above-moderate units than projected in the inventory, but 36 <br /> fewer moderate-income units. However, the inventory of sites provides a buffer of 56 units in <br /> excess of the City's assigned 894-unit moderate income regional housing needs allocation <br /> (RHNA). As a result, the approval would not require re-zoning of additional sites to meet the <br /> moderate income RHNA. <br />
