RESOLUTION NO. 2024-021 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON TO <br /> APPROVE AN INTERIM POLICE CHIEF AGREEMENT <br /> WHEREAS, Police Chief David Swing is leaving his service with the City effective May 2, <br /> 2024; and <br /> WHEREAS, while the City undertakes a recruitment for a new chief of police, an interim <br /> police chief is needed for adequate staffing and public safety; and <br /> WHEREAS, Gina Anderson is the retired City of Newark Police Chief, and is qualified and <br /> available to serve as the City's Interim Police Chief; and <br /> WHEREAS, while the appointment of the police chief is a duty of the City Manager (see <br /> Municipal Code §2.08.100), state law requires that in this circumstance when a position is vacant <br /> and a recruitment is being undertaken that if a retiree is assuming the interim position that the <br /> City Council must approve such interim appointment (see Cal. Government Code §21221(h)). <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. Approves the Interim Police Chief Agreement to have Gina Anderson serve <br /> at the City's Interim Chief of Police beginning on May 3, 2024, during the recruitment for a <br /> permanent police chief, subject to the terms and conditions in the attached Exhibit A. Authorizes <br /> the City Manager to: (i) execute the agreement, with minor modifications approved by the City <br /> Manager, Human Resources and Labor Relations Director and City Attorney; and (ii) to exercise <br /> his discretion to terminate the agreement as provided in Section 8 of the agreement. <br /> SECTION 2. This resolution shall be effective immediately upon its passage and <br /> adoption. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on April 16, 2024. <br /> I, Jocelyn Kwong, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on April 16, 2024, by the . <br /> following vote: <br /> Ayes: Councilmembers Arkin, Balch, Nibert, Testa, Mayor Brown <br /> Noes: None <br /> Absent: None <br /> Abstain: None <br /> Jo yn Kw g, ty Clerk <br /> APPROVED AS TO FORM.- <br /> Daniel <br /> ORM:Daniel G.
