Resolution No. 2024-020 <br /> Page 2 of 3 <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: <br /> SECTION 1. This Resolution of Summary Vacation for Public Service and Access <br /> Easements and Acceptance of Replacement Public Service and Emergency Vehicle Access <br /> Easements at 4452 Rosewood Drive is hereby adopted based on the following: <br /> • The summary vacation of Public Service and Emergency Vehicle Access <br /> Easements is made under California Streets and Highways Code §8330 et seq. <br /> • The Public Service and Emergency Vehicle Access Easements to be summarily <br /> vacated were granted across Lot 59 of Parcel Map 3863 (Book 161 of parcel maps <br /> at Pages 15 through 30) as accepted by the City Clerk and as described in detail <br /> in the Quitclaim Deed of Emergency Vehicle Access Easement, Quitclaim Deed of <br /> Public Service Easement across Parcel 59B, and Quitclaim Deed of Public Service <br /> Easement across Parcel 59C to be recorded together with this Resolution. <br /> • This Resolution is prima facie evidence that the Public Service and Emergency <br /> Vehicle Access Easements are superseded by relocation or determined to be <br /> excess. <br /> • That from and after the date this Resolution is recorded, the vacated Public Service <br /> and Emergency Vehicle Access Easements no longer constitute a street, highway, <br /> or public service easement. <br /> • That all entities having any right, title, or interest in the Public Service and <br /> Emergency Vehicle Access Easements being vacated have been notified of this <br /> action. <br /> SECTION 2. The City Manager shall execute the Quitclaim Deed of Emergency Vehicle <br /> Access Easement, the Quitclaim Deed of Public Service Easement across Parcel 59B, and the <br /> Quitclaim Deed of Public Service Easement across Parcel 59C. <br /> SECTION 3. The City Clerk shall cause a certified copy of this Resolution, as attested <br /> under seal, to be recorded without acknowledgment, certificate of acknowledgment, or further <br /> proof in the office of the Alameda County Recorder together with the fully executed Quitclaim <br /> Deed of Emergency Vehicle Access Easement, Quitclaim Deed of Public Service Easement <br /> across Parcel 59B, and Quitclaim Deed of Public Service Easement across Parcel 59C. <br /> SECTION 4. The City Manager shall accept the Grant of Emergency Vehicle Access <br /> Easements across Parcel 59B, the Grant of Emergency Vehicle Access Easement across Parcel <br /> 59C, the Grant of Emergency Vehicle Access Easements across Parcel 591 Revised, and the <br /> Grant of Pedestrian Access Easement across Parcel 59C as authorized by City Council <br /> Resolution No. 89-31 adopted on January 17, 1989. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on April 16, 2024. <br /> {Vote and signatures to follow on next page) <br />
