ADOPT RESOLUTIONS TO AMEND THE PURCHASING <br />PROCEDURES AND MANUAL; AND UPDATE THE MASTER FEE SCHEDULE <br />FOR SMALL WIRELESS FACILITY APPLICATION FEES AND POLICE <br />DEPARTMENT FALSE ALARM FINES <br /> <br />SUMMARY <br />The omnibus ordinance is a regular process to update the municipal code to reflect new state <br />laws, and have the code reflect current practices. These amendments are non-controversial <br />and presented as one ordinance. Omnibus changes include: <br /> <br />Chapter 1.22 Voluntary campaign contribution and expenditure limitations – State law now <br />requires a local candidate to establish a separate controlled committee and campaign bank <br />account for each separate office. <br />Chapter 1.24 Administrative citations – Allow administrative citations to be issued for zoning <br />code violations, as permitted by state law. <br />Chapter 5.20 Exemptions – State law exempts family day care homes from local business <br />licenses. <br />Chapter 6.56 Alarms – Update fines for false alarms, which amounts have not changed since <br />1985. Change time period for cumulating false alarms and updating circumstances when alarm <br />response may cease. <br />Chapter 13.08 Parks and Recreation Facilities – Prohibit dogs from tennis, pickleball, volleyball <br />and bocce courts to prevent damage court surfaces and dog waste is a health and safety <br />concern; and have policy requirements for alcohol service during recreation facility rentals. <br />Title 18 Zoning - Amendments to implement Housing Element programs and policies, and align <br />with state law for low barrier navigation centers, single room occupancy unit facilities, <br />supportive housing, residential care facilities, accessory dwelling units (ADU) and homeless <br />shelters. Also update Chapter 18.144 Appeals to reflect the City Council Rules of Procedure <br />and address court decisions to preserve due process. <br /> <br />There are two resolutions to: <br />Amend the Purchasing Procedures and Manual to: (a) add a definition for public project to <br />align with state law; and (b) clarify that the City Manager, Public Works and Finance Directors <br />must approve exigent circumstances to allow a capital improvement project to exceed the <br />contract amount before having an amendment ratified by the Council. <br />Amend the Master Fee Schedule to update: Police Department false alarm fines; and Planning <br />Division small wireless facility application fees; and provide for annual inflation adjustment. <br />Page 6 of 559
