Page 1 of 2 <br />Item #3 <br /> CITY COUNCIL AGENDA REPORT <br /> <br />April 16, 2024 <br />City Clerk <br /> <br />TITLE: ADOPT A RESOLUTION AMENDING THE LOCAL CONFLICT OF INTEREST <br />CODE AND UPDATING THE LIST OF DESIGNATED POSITIONS REQUIRED TO <br />FILE STATEMENTS OF ECONOMIC INTERESTS <br /> <br />SUMMARY <br />California law requires the City to regularly update its local conflict of interest code. The <br />proposed resolution updates the local conflict of interest code to reflect the state’s <br />amendments to the model code, as well as changed staff positions subject to public disclosure <br />requirements. <br /> <br />RECOMMENDATION <br />Adopt a resolution amending the local Conflict of Interest Code and updating the list of <br />designated positions required to file Statements of Economic Interests. <br /> <br />BACKGROUND <br />The California Political Reform Act (the Act) requires each city to adopt a local conflict of <br />interest code (See California Government Code (GC) §§81000 et seq. and GC §§ 87306 and <br />87306.5). The policy goal of the Act is to ensure that public officials do not make government <br />decisions in which the official has a financial conflict of interest. The California Fair Political <br />Practices Commission (FPPC) adopts a model local conflict of interest code which cities may <br />adopt as their own local code. <br /> <br />Pleasanton has historically adopted the FPPC’s model local code with modifications that reflect <br />Pleasanton’s elected officials, appointed commissioners and committee members, and staff <br />positions subject to varying levels of public disclosure of economic interests. The City last <br />updated its local conflict of interest code in 2022 (Resolution No. 22-1329). This current update <br />reflects changes to the FPPC’s model code, as well as changed staff positions and <br />commissions. <br /> <br />DISCUSSION <br />Since the last update of the City’s local conflict of interest code, the FPPC has made changes <br />to its model local conflict of interest code (See Title 2 Cal. Code of Regs. §18730). <br /> <br />In addition, City staff titles and positions resulting from the creation of the new Public Works <br />Department are included, as well as any new or removed commissions resulting from the <br />committee and commission restructure approved by the City Council this spring. <br /> <br />The proposed resolution amending the local conflict of interest code (Attachment 1) includes <br />the FPPC’s model code in Exhibit A, and the revised City positions in Appendix A (as <br />highlighted). <br /> <br />Page 57 of 559
