Resolution No. <br />Page 2 of 3 <br />SECTION 2. Amends the Purchasing Procedures and Manual by adding a new Section <br />4.3.5. as follows: <br />4.3 Public Works Projects. <br />4.3.5. Administrative agreement amendment in time-critical situations <br />4.3.5.1. Amendments to increase the scope of work for a previously approved <br />public works project agreement may be administratively approved by the <br />City Manager, Director of Public Works, and Director of Finance in time- <br />critical situations for: (a) agreements approved by the City Council <br />pursuant to 4.3.4., above; and (b) agreements where such extra work <br />would make the revised agreement amount exceed $200,000. <br />4.3.5.2. A time-critical situation is when an unforeseen circumstance arises during <br />the course of a public works project and an immediate change-order is <br />needed to add extra work or materials to: (a) minimize time that active <br />construction projects impact critical transportation and services (e.g. <br />open trench closing street or park); (b) maintain schedule coordinated <br />with other agencies or utilities (e.g. work timeline during limited season <br />that state agency allows work in stream); or (c) prompt attention reduces <br />total costs (e.g. construction project encounters underground storage <br />tank that must be removed and delay will increase mobilization costs). <br />Such time-critical determination shall be made in the reasonable <br />judgment of the Director of Public Works and concurrence by the City <br />Manager and Director of Finance or their designees. <br />4.3.5.2. An amendment to add such time-critical extra work to a public works <br />project agreement may be administratively approved by the City <br />Manager, but must be brought to the City Council for ratification and <br />funding allocation at the next Council meeting when noticing and agenda <br />requirements can reasonably be met. <br />SECTION 2.
