5

Proposal
Technical Editor. These services will also include ongoing support to City staff, such as regular schedule
updates and discussions of technical issues.
Task 9: Preparation of Mitigation Monitoring and Reporting Program
FCS will prepare an MMRP, pursuant to CEQA Guidelines Section 15097. The MMRP will summarize the
mitigation measures from the Housing Element Update Program EIR that would be applicable to the
proposed project along with any necessary refinements to those mitigation measures, if necessary, in
accordance with CEQA Guidelines Section 15183. This Scope includes time to address one round of city
comments on the MMRP.
Tasks Outside the Scope of Work
The following are tasks FCS has identified as falling outside its Scope for the proposed project.
Written Responses to Comments
CEQA Guidelines Section 15183 Checklists do not need to be circulated for public review. As such, this
Scope does not include time or budget for preparing written responses to comments received. Should
City staff request that FCS prepare written responses to comments, a separate scope and fee will be
prepared.
Newspaper Noticing/Local Noticing
FCS assumes that City staff will be responsible for noticing public meetings at which IS/Consistency
Checklist may be considered as part of project approval.
Notice of Determination Filing/Payment of Fees
The CEQA Guidelines do not explicitly state that a Notice of Determination (NOD) needs to be filed in
conjunction with the adoption of a Consistency Checklist. However, it is recommended that an NOD be
filed with the Alameda County Clerkâs Office within five business days of project approval to ensure that
the legal challenge period is limited to 30 days. The NOD filing requires payment of a County handling
fee and CDFW filing fee. This Scope assumes the City will prepare the NOD and the City/applicant will be
responsible for filing the NOD and paying the requisite fees.
Scope of Work Modifications
FCS assumes a stable and complete Project Description and project plan set at project initiation. In the
event the Project Description and/or Scope change to a degree that alters the fee estimate, FCS will
contact City staff in writing to submit a revised fee for mutual agreement, and a contract amendment
will be processed. Requests for additional work will be documented, and a completion timetable and
estimated fee will be submitted for City approval.
DocuSign Envelope ID: 8A0CA7AE-0205-438E-B096-2D2D28D11092DocuSign Envelope ID: 19AA1EA2-E6E2-4979-84F3-4D0C7027628D
