PLEASE READ IT CAREFULLY. <br />EXCLUSION – DRYWALL TOXINS <br />This endorsement modifies insurance provided under the following: <br />COMMERCIAL EXCESS LIABILITY POLICY <br />A. The following exclusion is added to Paragraph 2. Exclusions of SECTION I –COVERAGES: <br />2. Exclusions <br />Insurance provided under this policy does not apply to: <br />a. “Injury or damage” that would not have occurred in whole or in part but for the actual, alleged, or threat- <br />ened contact with, exposure to, or discharge, dispersal, seepage, migration, release, escape, inhala- <br />tion, ingestion, existence, or presence of one or more “drywall toxins” at any time, regardless of whether <br />any other cause, event, material or product contributed concurrently or in any sequence to such “injury <br />or damage”. <br />b. Any loss, cost, or expense arising out of any: <br />(1) Request, demand, order, or statutory or regulatory requirement that any insured or others abate, <br />test for, monitor, clean up, remove, contain, treat, detoxify or neutralize, remediate or dispose of, <br />or in any way respond to, or assess the effects of, one or more “drywall toxins”; or <br />(2) Claim or suit by or on behalf of a governmental authority for damages because of abating, testing <br />for, monitoring, cleaning up, removing, containing, treating, detoxifying or neutralizing, remediating <br />or disposing of, or in any way responding to, or assessing the effects of, one or more “drywall <br />toxins”. <br />B. The following definition is added to SECTION IV – DEFINITIONS: <br />“Drywall toxins” are chemicals or compounds, whether solid, liquid, or gaseous, contained in or applied to cer- <br />tain drywall (also known as gypsum board, plasterboard, sheetrock, or wallboard) that, alone or in contact with <br />other elements, allegedly or actually damage property, corrode materials, emit noxious odors, cause health <br />problems, or otherwise act as a contaminant or irritant. They include, but are not limited to, butanethial, carbon <br />disulfide, carbonyl sulfide, hydrogen sulfide, iron sulfide, mercaptan, methylthio pyridone, sulfuric acid, sulfurous <br />acid, sulfur dioxide and strontium sulfide. <br />All other terms and conditions remain unchanged. <br />DocuSign Envelope ID: A181A6E1-38C6-4FC4-9DB3-55096154243F
