PLEASE READ IT CAREFULLY. <br />COVERAGE LIMITATION AND EXCLUSION – RESIDENTIAL <br />CONSTRUCTION OPERATIONS <br />This endorsement modifies insurance provided under the following: <br />COMMERCIAL EXCESS LIABILITY POLICY <br />A. The following exclusion is added to Paragraph 2. Exclusions of SECTION I – COVERAGES: <br />2. Exclusions <br />Insurance provided under this policy does not apply to: <br />a. Any "injury or damage" arising out of or in any way connected with, either directly or indirectly, your <br />ongoing operations, your product, or your work performed by or on behalf of any insured, either prior <br />to or during the policy period, that is incorporated into or performed at any of the following <br />construction projects: <br />(1) Any new townhouse or residential condominium project where the total number of individual <br />residential units located in: <br />(a) Florida or South Carolina is greater than ten (10); or <br />(b) Any state other than Florida or South Carolina is greater than twenty-five (25) <br />regardless of the number of buildings, developments, phases or associations; <br />(2) Any new "tract housing" project, where the total number of individual residential units located in: <br />(a) Florida or South Carolina is greater than ten (10); or <br />(b) Any state other than Florida or South Carolina is greater than twenty-five (25) <br />regardless of the number of buildings, developments, phases or associations; or <br />(3) Any conversion of buildings to condominiums or townhouses, regardless of the number of <br />buildings, developments, phases or associations. <br />With respect to a.(1) or a.(2) above, if the "underlying insurance" limits the number of units to a <br />number less than that shown in a.(1) or a.(2), then the number of units limitation in these paragraphs <br />is amended to follow the "underlying insurance". <br />b. Costs and expenses to investigate or defend any claim, suit or payment of any fine or penalty related <br />to any of the operations in a. above. <br />However, this exclusion does not apply to your work or your product performed by or on behalf of any <br />insured that is incorporated into a.(1), a.(2), or a.(3) after the issuance of the notice of completion or <br />certificate of occupancy, whichever comes first, unless such work performed is to repair or replace your <br />work or your product performed by or on behalf of any insured, that was incorporated into a.(1), a.(2), or <br />a.(3) prior to the issuance of the notice of completion or certificate of occupancy. <br />With respect to a.(2) each two-family dwelling will be considered two residential housing units, each <br />three-family dwelling will be considered three residential housing units, and so forth. <br />B. As respects this endorsement, the following definition is added to SECTION IV – DEFINITIONS: <br />"Tract housing" means a series of detached one, two, three, or four family dwellings located in a development <br />project, in which one or more parcels or plats of land are subdivided into multiple lots, tracts, parcels or other <br />subdivisions of land. <br />All other terms and conditions remain unchanged. <br />DocuSign Envelope ID: A181A6E1-38C6-4FC4-9DB3-55096154243F
