ORDINANCE NO. <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON CREATING <br />AN ENERGY AND ENVIRONMENT COMMISSION BY ADDING A NEW CHAPTER 2.31 <br />TO THE MUNICIPAL CODE, REPLACING THE COMMITTEE ON ENERGY AND THE <br />ENVIRONMENT <br />WHEREAS, since the City has been concerned about the preservation of environmental <br />quality and the conservation of energy, the City Council created the Committee on Energy and <br />the Environment by Resolution No. 08-234 in 2008, and extended the committee’s term on <br />February 16, 2016, February 17, 2017, and June 4, 2019, until making it a permanent committee <br />by Resolution No. 21-1201 in 2021; and <br />WHEREAS, the Committee on Energy and the Environment provided key guidance and <br />insight into the development of Climate Action Plan (CAP) 2.0 adopted in March 2022, as well as <br />the original CAP; and <br />WHEREAS, on October 17, 2023 and February 20, 2024, at duly noticed public hearings, <br />the City Council considered commission and committee reorganization, and determined that the <br />Committee on Energy and the Environment should be made a formal commission as these <br />members will have an important and on-going role implementing the CAP 2.0, as well as working <br />with staff to prepare an Energy and Environmental Priorities Plan to reflect community <br />opportunities, needs and interests. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />SECTION 1. Finds that the proposed amendments to the Pleasanton Municipal Code <br />have no possibility to have a significant effect on the environment per Title 14 California Code of <br />Regulations (CEQA Guidelines) § 15061(b)(3). <br />SECTION 2. Amends the Pleasanton Municipal Code as shown in Exhibit A, attached <br />and incorporated by this reference, to create a new Energy and Environment Commission. <br />SECTION 3.Repeals Resolution Nos. 08-234 and 21-1201 to disband the Committee <br />on Energy and the Environment, as it is being replaced with this new Energy and Environment <br />Commission. <br />SECTION 4.The existing six regular members of the Committee on Energy and the <br />Environment shall become commissioners on the new Energy and Environment Commission for <br />the remainder of their respective terms, with the most recently appointed regular member serving <br />as the alternate commissioner, the youth member serving in the same role, and current and prior <br />service on the committee counting towards years served when calculating maximum number of <br />years of service allowed on the commission. <br />SECTION 5.A summary of this ordinance shall be published once within fifteen (15) <br />days after its adoption in “The Valley Times,” a newspaper of general circulation published in the <br />City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City <br />Clerk’s office within fifteen (15) days after its adoption. <br />ATTACHMENT 2 <br />Page 22 of 228
