PUD-148, 2207 Martin Ave. Planning Commission <br />2 of 4 <br />the applicant submitted more detailed plans of the tennis court, and clarified information on <br />existing landscaping, allowing some conditions to be simplified and clarified by staff. Staff is <br />now seeking the Commission’s review and affirmation of the modified conditions so that a <br />recommendation can be forwarded to the City Council. <br /> <br />SITE AND AREA DESCRIPTION <br />The subject property is a flat, approximately 1.67-acre site located between Martin Avenue and <br />Dennis Drive and is developed with an approximately 4,173-square-foot two-story single-family <br />residence with an attached garage built in 1977 (see Exhibit C, Figure 1). Additionally, the <br />general area is zoned Planned Unit Development-Low Density Residential (see Exhibit C, <br />Figure 6). <br /> <br />PROPOSED PROJECT <br />The applicant/property owners propose to establish development standards for the subject <br />parcel consistent with those of the R-1-40,000 Zoning District for the existing residence and <br />accessory structures. The proposal also includes a new tennis court with specific provisions to <br />establish development standards for sports court fencing (see Exhibit B). <br /> <br />Planning Commission Hearing and Action <br />The Planned Unit Development application (PUD-148) was heard by the Planning Commission <br />on August 23, 2023. At the hearing, there were comments made both in support and against <br />the application regarding development standards for a tennis court. Particular concern was <br />raised by the adjacent property owners at 3520 Dennis Drive regarding potential lighting <br />impacts, height of tennis court fencing, and proximity of the tennis court to their residence. In <br />response, the applicant/property owners stated that no lighting is currently proposed and that <br />they were amenable to reasonable mitigation measures, such as vegetation screening and <br />increasing the height of the existing shared wood fence on the property line, with the latter <br />based on an understanding that the neighbor at 3520 Dennis Drive was amenable to sharing <br />the cost of increasing the height of the fence. <br /> <br />After discussion, the Planning Commission motioned to recommend approval to the City <br />Council with modified Conditions of Approval for the tennis court and fencing. <br /> <br />The motion articulated some of the amended conditions in detail, such as the design of the <br />tennis court fencing, landscaping, and property-line fencing. However, it was silent on several <br />other aspects and did not reference the other staff-recommended conditions of approval. <br /> <br />Staff subsequently prepared a revised resolution reflecting an interpretation of the Planning <br />Commission’s motion, which was shared with the applicant in advance of the scheduled City <br />Council hearing on September 19, 2023. The applicant/property owners contacted Planning <br />staff to express their differing interpretation of Planning Commission’s motion. In response, <br />staff requested the item be continued from the scheduled City Council agenda, to allow further <br />discussion with the applicant/property owners. <br /> <br />DISCUSSION/ANALYSIS <br />Following the August 23 hearing, in addition to meeting with staff to discuss the proposed <br />conditions, the applicant/property owner submitted an updated narrative and more detailed <br />plans of the tennis court, as well as photo documentation of existing landscaping along the <br />fence line.
