Page 1 of 7 <br />Item #3 <br /> CITY COUNCIL AGENDA REPORT <br /> <br />January 16, 2024 <br />Community Development <br /> <br />TITLE: INTRODUCE AND WAIVE FIRST READING OF AN ORDINANCE APPROVING <br />AN APPLICATION TO ESTABLISH DEVELOPMENT STANDARDS AND <br />CONSTRUCT TENNIS COURT FENCING FOR AN EXISTING SINGLE-FAMILY <br />RESIDENCE LOCATED AT 2207 MARTIN AVENUE (PUD-148) <br /> <br />SUMMARY <br />The applicant/property owners are proposing to establish development standards for the <br />subject parcel, and are seeking approval to construct fencing around an existing tennis court <br />on the property located at 2207 Martin Avenue. The property includes an existing single-family <br />residence constructed prior to the parcel’s annexation into the city in 1997. Although the parcel <br />is part of an area for which Planned Unit Development (PUD) zoning was previously approved, <br />it does not have an approved PUD development plan, which is necessary to establish <br />development standards and uses for any development of the parcel. Approval of the PUD <br />development plan requires review and recommendation by the Planning Commission to the <br />City Council for action. The Planning Commission recommended approval of the project at a <br />hearing on August 23, 2023; and at its December 13, 2023, public hearing, affirmed its <br />recommendation for approval of the project subject to modified conditions of approval. The <br />item is now presented to the City Council for consideration and approval. <br /> <br />RECOMMENDATION <br />1. Find the project is exempt from environmental review pursuant to the California <br />Environmental Quality Act Guidelines (CEQA); and <br />2. Make the PUD considerations for the proposed development plan as stated in the draft <br />ordinance provided as Attachment 1; and <br />3. Introduce and waive first reading of an Ordinance approving an application to establish <br />development standards and construct tennis court fencing for an existing single-family <br />residence located at 2207 Martin Avenue (Case No. PUD-148), subject to conditions of <br />approval listed in Exhibit A of Attachment 1. <br /> <br /> <br />BACKGROUND <br />The property at 2207 Martin Avenue is located near the north end of Martin Avenue and is part <br />of the Mohr-Martin area, generally defined by Martin Avenue, Mohr Avenue, the former <br />Southern Pacific Railroad right-of-way, and Stoneridge Drive. The Mohr-Martin area comprises <br />predominantly residential uses of varying densities and home designs. Many of the properties <br />within the area were originally located in unincorporated Alameda County but were <br />progressively annexed into the city during the 1990s; thus, many of these properties were <br />subdivided and developed in conformance to planning, zoning, and construction standards of <br />Alameda County. <br /> <br />Page 21 of 201
