PLEASE READ IT CAREFULLY. <br />EXCLUSION – TOXIC METALS <br />This endorsement modifies insurance provided under the following: <br />COMMERCIAL EXCESS LIABILITY POLICY <br />A. The following exclusion is added to Paragraph 2. Exclusions of SECTION I –COVERAGES: <br />2. Exclusions <br />Insurance provided under this policy does not apply to: <br />a. “Injury or damage” arising, in whole or in part, out of the actual, alleged, threatened or suspected <br />inhalation of, ingestion of, contact with, exposure to, existence of, or presence of, “toxic metals". <br />b. Any loss, cost or expense arising, in whole or in part, out of the abating, testing for, monitoring, cleaning <br />up, removing, containing, treating, detoxifying, neutralizing, remediating or disposing of, or in any way <br />responding to or assessing the effects of, "toxic metals", by any insured or by any other person or entity. <br />c. The cost or expense of compliance with any law or regulation regarding "toxic metals”. <br />d. Any obligation to share damages with or repay someone else in connection with a., b., or c. of this <br />exclusion. <br />B. The following definitions are added to SECTION IV - DEFINITIONS: <br />1. "Toxic metals" are individual metals and metal compounds that negatively affect people's health. "Toxic <br />metals" include, but are not limited to, arsenic, beryllium , "heavy metals", or hexavalent chromium. <br />2. "Heavy metals" are a group of elements between copper and bismuth on the periodic table of the elements <br />having specific gravities greater than 4.0.
