<br />Resolution No. PC-97-30 <br />Page 4 <br /> <br />EXHIBIT "B" <br /> <br />Proposed Conditions of Approval <br />Case UP-96-82 <br />Almaden Restaurant Group, Inc. - Pedro's Restaurant and Cantina <br /> <br />I. The proposed use shall conform substantially to the site plan, floor plans, written <br />narratives, and related materials, Exhibit A (dated "Received" February 24, and <br />March 31, 1997), on file with the Planning Department, except as modified by these <br />conditions. <br /> <br />2. If operation of this use results in conflicts pertaining to noise, parking, litter, <br />traffic/circulation, loitering, fighting, or other factors, at the discretion of the Planning <br />Director, this conditional use permit may be referred to the Planning Commission for <br />subsequent review at a public hearing. If necessary, the Commission may modify or add <br />conditions of approval to mitigate such impacts, or may revoke said conditional use <br />permit. <br /> <br />3. A study involving the measurement of noise during a dancing and music event shall be <br />conducted by staff within 30 days of approval of this use permit to determine if noise <br />levels are in conformance with the City's Noise Ordinance. <br /> <br />4. If additional activities beyond that proposed in the written narrative, dated "Received" <br />February 24, and March 31,1997 on file with the Planning Department, are desired, prior <br />City review and approval is required. Such modifications shall be submitted to the <br />Planning Director, who may approve the modification or refer the matter to the Planning <br />Commission if judged to be substantial. <br /> <br />5. If, at any time in the future, the activities of the operation deviate from those described in <br />Exhibit "A", or in the event that nuisances are created through the operation of the <br />bar/cantina and/or dancing and music activities, either within the bar/cantina itself or by <br />its patrons in the vicinity of the bar/cantina, the Planning Director may refer this <br />conditional use permit to the Planning Commission for its subsequent review at a public <br />hearing. If necessary, the Commission may add or modifY conditions of approval to <br />mitigate such impacts, or may revoke the conditional use permit per Municipal Code <br />Section 18.124.130. <br /> <br />6. During the hours of operation of music and dancing events, a minimum ofthree security <br />personnel, in addition to the other employees, shall be on-site at all times. Two of the <br />security personnel shall patrol the parking lot surrounding the building and one security <br />staff shall be located at the entrance to the bar/cantina. The security personnel shall be <br />uniformed and shall dissuade any potentially illegal or nuisance-causing activities. Any <br />disturbances or illegal activities shall be reported immediately to the Pleasanton Police <br />Department. <br />
