The proposed location ofthe conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The proposed dancing and music activities will be contained completely within <br />the building on the site. Sufficient parking, ample traffic capacity, clear <br />separation from the residential neighborhoods, and security for the use have been <br />provided. In addition, noise levels have been conditioned to comply with the <br />City's Noise Ordinance and the project has been conditioned to have a follow-up <br />noise study conducted to ensure compliance. The parking lot is well-lit, and the <br />applicants will employ security personnel to ensure appropriate behavior of its <br />patrons both within and outside of the facility. All streets around the site are <br />designed per City standards to provide safe ingress and egress into and out of the <br />site. The applicants can also be required to mitigate future nuisances as a result of <br />the proposed use. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />The site's PUD-ICO zoning conditionally permits the establishment of dance <br />clubs and bars, as defined by the Municipal Code. In addition, the proposed <br />modification to the existing restaurant use complies with all relevant sections of <br />the zoning ordinance. Granting a conditional use permit to the applicants would <br />be consistent with the City's ability to regulate zoning as listed in the Municipal <br />Code Chapter 18.124. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project. <br /> <br />WHEREAS, the Planning Commission determined that if operated in a non-nuisance manner, <br />the proposed dancing and music activities and the extended hours of operation <br />will be compatible with the surrounding neighborhood and is appropriate for the <br />site. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case UP-96-82, the application of Almaden Restaurant Group, Inc. - <br />Pedro's Restaurant and Cantina, for a conditional use permit to allow music (Live <br />bands and recorded DJ) and dancing, and to extend the hours of operation at <br />Pedro's Restaurant and Cantina located at 5075 Hopyard Road (Site lA, Hacienda <br />Business Park), subject to the conditions shown in Exhibit "B," attached hereto <br />and made part of this case by reference. <br />
