The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the <br />public health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />The proposed convenience market will be contained completely within the retail <br />building on the site. Sufficient parking, ample traffic capacity, clear separation <br />from the residential neighborhoods, maintenance of noise levels, safety and <br />security within the premises have been provided. Sound walls exist on the <br />property lines shared with residential uses, and landscaping will be replanted in <br />the rear to complete the buffer strip. All streets around the site are designed per <br />City standards to provide safe ingress and egress, into and out of, the site. <br />Conditions have been included that would limit the hours of garbage disposal and <br />deliveries, which would reduce possible adverse impacts on the adjacent <br />residences and tenants. The applicants can also be required to mitigate future <br />nuisances as a result ofthe proposed use. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of this chapter. <br /> <br />The site's PUD-C-N zoning conditionally permits the establishment of <br />convenience markets. In addition, the proposed use complies with all relevant <br />sections of the zoning ordinance. Granting a conditional use permit to the <br />applicants would be consistent with the City's ability to regulate zoning as listed <br />in the Municipal Code Chapter 18.124. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Action; and <br /> <br />WHEREAS, the Planning Commission determined that the proposed convenience market use is <br />compatible with the surrounding neighborhood and is appropriate for the site. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1 <br /> <br />Approves Case UP-97-03, the application of Todd Fujinaga/Bonfare Market for a <br />conditional use permit to establish a convenience market, Bonfare Market, in an <br />approximately 3, I 00 square foot tenant space located at the Vintage Hills <br />Shopping Center (3550 Bernal Avenue, Suite 110), subject the conditions shown <br />in Exhibit "B," attached hereto and made part of this case by reference. <br /> <br />Section 2. <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
